Myla Underwear refusing faulty return

PLEASE HELP
I have returned a very expensive Myla underwear set to Myla as the black silk has totally faded on it.
The set is hand wash and I was honest and said items were washed in a laundry bag with hand wash liquid in a Miele washing machine - and now they say they will not refund me as machine washed and the underwear is hand wash.
Is this really so strict? Surely a gentle machine hand wash os not much different to a real hand wash?
Advice please as £350 out of pocket!
Thanks.

Probably not, but by admitting that the items were put through a washing machine (however gentle the program), Myla are well within their rights to refuse any refund.

All you can really do is to ask them to return your items back to you.

So you bought some expensive underwear that was described as hand wash only, you used a washing machine which caused it to fade but you aren't sure if you are responsible? Here's a clue - you are responsible.

On a separate issue. I filled my car up at the petrol station, drove down the street and the engine seized up. The owner's manual says that I should only use diesel but I used petrol, is it really this strict or are they being unreasonable?
  • £350 for a set of undies I would expect to be able to jet wash the thing

    And then what?

If the OP is honest and states that they failed to follow the washing guide, the chances of them getting a refund are slim to none, or do you suggest that they lie and hope that there is no record of their first attempt to get a refund?
  • Yes .

Can you state the OP is 100% responsible and that there is 0% chance of there being an inherent fault? I know I cant.

A tv manufacturer state the tv isnt to be left on standby. You leave it on standy and somewhere down the line, the tv breaks. Does that mean its automatically your fault or is it only your fault if the fault is caused by your actions?

While it is entirely possible they have faded due to not being hand washed....its also possible they've faded due to not receiving the appropriate treatment at time of manufacture.

Not following care instructions does not make you liable for inherent faults. It only makes you liable for faults arising due to that improper care.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • But I do not think there is an obvious link between leaving a TV on standby and it's failure but there is (to me) a very obvious link between washing a handwash only item in a machine and it fading - it's not an apt comparison.

Sorry OP, you've gone against some explicit instructions and admitted it - I think you'd lose this trying to enforce your rights.

Would you wash a pure wool sweater in the machine?

You pays your money and takes a chance if you don't follow the washing instructions.
