Who decided not to purchase chancel repair liability insurance?

I can't find any mention of this in any of my mortgage documents. How can the solicitors claim it is compulsory... who is doing the compelling?0

I suspect they just want to sell it to me either because they get a kick-back from the "insurer" and/or because it's the done thing these days. I'd rather just put a match to a piler of tenners, I'd get more from that.
I don't want to annoy, and they used a fairly firm tone in that last message. It wasn't ever offered to me as an option, just stated that they WILL arrange it for me, whether I want it or not.
Also I'm conscious of the fact that if I bother them with too much extra correspondence I may run up further fees.0 -
The solicitor's instructions are sent to them by the lender with their copy of the mortgage offer. If not specifically in the instructions, the lender may have a standing requirement in the CML Handbook, the bible solicitors have to follow for each lender's requirements.I am a mortgage broker. Should I get a copy of that as well, with the same content? I've not received paper from my lender yet, only an electronic confirmation that the offer is approved and forthcoming. Is it possible that the solicitor has seen more than I have?0 -
No. The solicitor gets his instructions from the lender which is also his client.

Well I got all the paperwork and info from the lender, and there is a section on compulsory insurance but no mention whatsoever of CRL insurance. I suspect the solicitors are selling it on commission - unless the lender themselves tells me I need it, I'll refuse to purchase it from them.0

rip off insurance, unless the house is in the middle of no where with nothing nearby but a parish.
it would cost such a tiny amount per house owner in a populated area that even if the parish actually asked for money it wouldn't be worth their while enforcing payment, legal costs would be higher than the money they were chasing!0 -
Morning, going through a house purchase at the moment and a chancel search was done and stated:-
The above building is located within the historical boundary of a tithe district within a parish chancel repair liability which continues to have a potential based upon historical parish boundary data and the relevant Inland Revenue Indices held by the National Archive
Looks like I can get some insurance for around £60-70, but to do a further search to find out for certain costs more from the sounds of it. Sounds a bit of a money spinner?
To be safe I will take out the insurance but are there any plans anyone is aware of that will eradicating chancel liability in the future? Ive only ever bought a new build and apartment before and not come across this before. Now it is a 1920-1930s house.
