PPI with C&G Mortgage

My wife took on a mortgage back in 2004 at our local C&G branch. As far as she remembers PPI wasn’t discussed & she certainly wouldn’t have agreed had it have been offered.
I took a look at her paperwork yesterday and noticed that for 3 years after that PPI was added to the monthly payment. Obviously PPI is rightly or wrongly a hot topic with everyone jumping on the bandwagon at the drop of a hat.
I wanted to run this by the exports in this forum to see if I have grounds for complaint. I know that PPI on mortgages can be tricky so before I waste time on a hiding to nothing I thought I would put this out for advice

What would be the reasons for complaint?
it was set up correctly (monthly premium) and if she didnt want it why did she not cancel it or raise it as a problem 8 years ago?I am an Independent Financial Adviser (IFA). I think the issue is that she wasn't made aware of the product at any point of the negotiations. I guess you could argue that it is up to her to check her statements.
Surely these products should be "opt in" as opposed to "opt out without being told it is included".0 -
The problem is that what evidence is there to say she didnt want it. I havent done a mortgage since the late 90s but used to do a lot of C&G mortgages. Their MPPI application then was a standalone application, not part of the mortgage application and was signed. You couldnt just add it. It had to be completed and signed. Cancellation rights issued and policy document issued. I don't know what it was by 2003 though.
We cant judge bank complaints as they are so scattergun in their responses. We also dont know if there are other issues. However, based solely on what you have said and nothing else, that is pretty weak complaint.I am an Independent Financial Adviser (IFA).
