Esa85 - query

I just got back my esa85 medical report back, and am quite happy.

Its saying that I meet the support group criteria for the fact that I suffered from shortness of breath whilst walking of 25 metres.

It took into account all the other issues.

Its saying that "available evidence suggests review in the medium term" but doesn't give how many months!!??

Does this mean that I will now be transfered from IB onto support group ESA!!??

Bit confused about this, but thanks for the help ..:D

    It may.
    The ESA85 (medical report) means that in the HCPs opinion, you qualify for the support group.
    The decisionmaker in principle could choose to overrule this, based on other evidence.

    In most cases, they will not.

    And 'in the medium term' seems to be DWP speak for 'between one and three years' - though there is probably no actual hard figure.

  • Agree with roger's advice. It could be some time before they take decision. But this is great news. Shame they don't seem to give actual number of months for prognosis as it'll likely indicate timing of reassessment from date of decision... however the award letter (assuming it follows from the ATOS recommendations) may give details... one can only hope as far as DWP ESA documents are concerned. I've only had one decision letter regarding my ESA in 3.5 years and that was before I ever was assessed... letter said I'd failed...lol

  • Yes... you'll continue to be an IB claimant until they take a decision at DWP regarding ESA. Your ESA claim will start on that day and any payment adjustments will take place the same day. Others may be better able to give specific payment details... transitional protection is a factor to consider probably... the idea that upon successful transfer you shouldn't lose out financially at least for a period of time.

    I understand you'll be transferred to contrib based which would be taxable... as opposed to Income related which isn't.
