Parking Eye - cancelled ticket!!

Yep, you read it correctly! My recent "invoice" from P.E has been cancelled following my "appeal". I'd only "appealed" in an attempt to get a POPLA reference so I could cost them more money, and what do the miserable so-and-so's do, but cancel my ticket!! That's just no fun :(
However, there are a couple of other possible explanations . . .
1: They haven't succeeded on previous occasions in getting any money out of me, so maybe they thought they were onto a loser anyway? (But then why send out the ticket in the first place?) Or
2: I'd written to the DVLA to complain that they'd included info on the PoFA with the ticket, explaining that as I live in Scotland it was misleading. So maybe they didn't want to get in the cacky?
Perhaps I'll never know :( However, it's not gonna stop me trying to get more! :)
Any thoughts . . . ?

    Look we don't need POPLA, we do listen to appeals. See:
    *hands man from governement big file full of successful appeals*

    Now you can get rid of POPLA.

    Something tells me they've probably been hit with a lot of popla costs from people who still don't pay irrespective of he outcome :D

    Imagine 2-300 £35 popla costs and not seeing a penny from any of those motorists.

    Serves them right. They've brought it on themselves.

    I suspect we'll start seeing a lot more successful cancellations now.

    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Somehow my car was allegedly parked for longer than the free period, a few weeks later I got one of their invoices and told them No and not to write to me again. They wrote again so I asked for a POPLA code and this is what they sent back.

    So they've ignored my appeal and are ignoring my request for a POPLA reference code.

    Did you actually 'appeal' to them in the correct way?? Is there a correct way(I havent had a ticket yet!). If there is and you didnt then they would not give you a POPLA reference No. I suspect.

    I'd just reply with:

    "Thank you for your letter dated xxx, which clearly states that the charge you seek is for 'breaking the terms and conditions.'

    The charge demanded is not a genuine pre-estimate of loss due to this alleged breach of contract and thus amounts to a unenforceable contractual penalty.

    Please supply me with the following in your reply:

    • The name of the landowner
    • A copy of the contract you hold with the landowner (In particular I am interested in whether Parking Eye hold any proprietary interest in the land in question (see VCS v HMRC), and whether the contract permits you to bring any legal proceedings (see Somerfield v Parking Eye)
    • A POPLA code should you fail to cancel the charge"

    I emailed Parking Eye appealing my invoice (less appeal more me telling them to do one) I requested a final decision and a POPLA number if rejected.

    They sent me a short letter, to the effect of the last few paragraphs of yours. Ie we will put it on hold for 14days as we cannot cancel it based on the evidence provided, they also gave me a (non freephone) number to phone and pay.

    I emailed them back in size 50 red font asking for a POPLA number cos they aint getting any evidence. Please also note that I have actually not broken the rules of their car park (see my first post here if you are interested)

    Looks like they dont want to pay £30. Too bloomin right as I didnt do anything wrong.

    I am very tempted to pop into the car park in the morning on the way to work, then again on the way home. Just to see if my ticket was a mistake, or if they actually are trying to trick people into paying them money by using the first in last out photos on their ANPR cameras.
