Guys you have been amazing. Haven't I ballsed up on the whole "go whistle" thing by contacting my DMP company and telling them to get in contact with them to arrange a payment plan?
I see no reason not to do a CCA request and advise your DMP company of the result.

It is common practice on a self managed plan to place a creditor with no CCA at the bottom of the pile - they get £1 if they are lucky until the rest are paid.

As above - they may have a compliant agreement. They may not. It will cost you £1 to find out.
  • How would i go about doing that?

    Hi

If you go to the National Debtline website there are template letters for all situations, there is one for the cca request.

I strongly advise you write to Lawrence Charlton and ask them what the hell is going on (a full breakdown of all payments made and make the letter an official complaint, you have paid them a lot in fees over 2 1/2 years). To tell you that Wescott have ceased trading is ridiculous and has caused you all sorts of problems. If you do not get a satisfactory reply, complain the the Financial Ombudsmann cos there is something fishy about his whole situation.

In the meantime though the priority is getting the cca request off and making our debt collecting friends squeal!

One things that does puzzle me though......why, if they only stopped paying Wesott in April.is the balance so large? Have they not been paying them for some time before that? Odd this, very odd.

It will be interesting to see what the response is from Law Charl and the Debt collectors.

Despite much wishful thinking by many people over the years, Wescot have definitely NOT gone out of business.

Thanks for the help. Will be taking this to my nephew to get sorted. I'm not sure whether he is on a dmp or a finance company consolidated loan. You know how these young ones are, they're so airy fairy about stuff. Will go and see if I can get to the bottom of who and what this is all about. He's been out of work for four months and the company seem to have had a very laid back approach to how much he pays them. I'm determined he gets this sorted whether he wants to or not because he's been paying it off for about 5-6 years now. Pesky kids.....
I got there - I'm debt free and intend to stay that way. If I haven't got the cash, it doesn't get bought. It's as simple as that.

    Hi Gem,

We provide free DMPs, so it'd be strange for us to recommend a fee charging DMP company. Could it have been a different advice organisation that referred you to Lawrence Charlton?

    Kind regards

    James
