Two quick points...
- Wescot have not gone out of business
- Contractual payment means one that was a normal payment as part of your credit agreement, i.e. your last normal monthly payment before you required a DMP.

Unfortunately, because I had been making payments to Westcott at the very beginning before they passed it over, they can physically trace payments to the debt, therefore acknowledging the debt.
Its actually more to do with the last time you made a payment on it. So, when was that? If it was 2006, then they can go whistle. If it was after that time, run them round in circles with CCA, Prove It and Statement of Account letters.
Frankly, I dont respond well to threats and I suspect neither do you. They have absolutely no rights on your property so tell any doorstepper to jog on. You have been and continue to do your level best to get control of this situation and the last thing you need is some nasty so-and-so making life difficult. Move to a free DMP provider and continue what you have been doing so well. Westcott will disappear.Debt Free! Long road, but we did it

Same here. Send a CCA but make sure you only sign digital and not actual so no CCA can suddenly appear. Then send them a seperate letter that you will only deal in writing with them and revoke their right to visit. If they still call, send a harrasment letter to them.
I had similar with Cougar in the past and in the end they even send me a letter appologizing to me
:rotfl: As soon as you have requested a CCA and they don't comply they have put the account into default, i.e. they can't take you to court. In the meantime, check when the last payment and acknowledgement was made (statements from your DMP provider and CRA's) and with a bit of luck you can send them a SB letter on top

I'm guessing this is a fee-charging company DMP? If so, you need to urgently leave this company and set up a DMP with a free provider such as StepChange or Payplan. StepChange have a great website and there is a section for people wishing to transfer their DMPs to them.
My nephew is with a fee paying company and getting nowhere fast in reducing his debt. I've looked at StepChanges website and can't see anything about transferring dmps to them as you suggested. Can you point me in the right direction.

Your DN needs to get hold of the terms and conditions of his existing DMP.
This will explain what fees are being deducted from every payment he makes and what notice he needs to give to terminate the DMP.
He gives the required notice then sets up a new DMP via stepchange, exactly as if he were a new client.
I would suggest a new basic bank account as a good precuation to prevent the existing provider or any of the creditors taking money oput of the old one.If you've have not made a mistake, you've made nothing0 -

It is an old card. While MBNA seem to be quite good at retaining agreements, if they fail on this you will be put firmly in the driving seat with this lot. It will cost £1 to find out and you loose nothing by asking.BSC No 248
