Scared and petrified following phonecall!!!

I really really need some advice please!!

I have been in a DMP with a well known company for the last 2 and a half years paying £300 a month to finally pay off my debts.

I had 3 debts with Lloyds TSB, one with New Look and one with Wescott, who were acting on behalf of MBNA.

I received a phone call from my DMP company yesterday informing me that I am due for a 6 month review, and that as a 4 of my debts have been cleared (1 Lloyds, New Look and Wescott), they would like to re work my payment. Fine.

However……I have just received a phone call from Debt Managers LTD stating that I owe over 3k for my MBNA credit card, and that the last contractual payment was made back in 2006!! I was of course shocked, and advised that I had been making payments and had been informed that the debt was cleared.

I got straight on the phone to my DMP company, who advised that they had stopped paying Wescott in April, as the company was no longer in business, and that the debt must have been passed elsewhere (I was not informed of this), and that the large amount of money that had been paid and held, was distributed to my over debts which ultimately paid them off. I provided them with the new reference for Debt Managers LTD, and they are now arranging a payment offer to them.

I called Debt Managers LTD to advise them of the situation, and the gentleman (if that’s what you can call him), was possibly the rudest, most condescending bloke I have ever spoken to. He kept on shouting that although everything I had done was OK, I needed to make a token payment, or otherwise they would be sending round doorstep collectors. I advised that I don’t get paid till next week and that I couldn’t make a payment and he promptly told me “Well, we will send someone round then”

I am absolutely petrified. I even cried. Can they really send people round even though I have told them that the situation is being sorted??

Sorry to go on, but I think I’ve just taken out my fear on the keyboard!!!

    Sorry to hear about that, but people with help and advice will be here with you shortly. They are likely to advise that if you are doing a DMP with a company you are paying you should stop that straight away as there are free services out there that do the same thing, or actually do it better!

    Do not despair, the cavalry are on their way!

    Who is your DMP with, is it one of the free ones? Can they give you a breakdown of all of your payments to date so you can work out who got what amount of money. They should really be communicating with the new DCA on your behalf, so I would call them and ask them to send an up to date income and expenditure to the DCA so that they can see how much money you will be paying to them.

    They will not send round a doorstep collector, they are saying this to frighten you, and it has worked. DCAs do not have any power to visit you anymore than the postman has, so try not to worry.

    Bailiffs can visit the home, but only if there has been a court order and I assume this has not happened. I would not call the DCA again, but speak to your DMP company and ask them to speak to the company of your behalf.

    I'm guessing this is a fee-charging company DMP? If so, you need to urgently leave this company and set up a DMP with a free provider such as StepChange or Payplan. StepChange have a great website and there is a section for people wishing to transfer their DMPs to them.

    In terms of what's been paid. .. do you have a breakdown of every payment this company has made, and to whom? If not then you need to demand this of them immediately.

    You can also always ring National Debtline for free impartial advice - they too have a website.

    Try not to worry to much - you need more facts before you know the whole picture.

    Don't you just love these nasty bullies? Scum of the earth.

    Move to Stepchange today or Payplan and do as the others have said, get a full breakdown of everything you have paid.

    If it was me I would start playing games with Debt Managers Ltd and refuse to pay them anything until they come up with a CCA and proof that the debt is valid. Do not pay them a token payment, not a dime.

    If they cant come up with anything id refuse to pay because of the knob head treating you like that, but thats me. I hate debt collectors with a passion.

    Oh and nobodys coming round to your house and even if they did just tell them to go away as they have as much power as me turning up at the door. ie none.

    If the last contractual payment was in 2006, then why not try for the statue barred approach? - I would send them the statute barred letter and let them prove that they can still chase you for the debt :)

    I tried that one!

    Unfortunately, because I had been making payments to Westcott at the very beginning before they passed it over, they can physically trace payments to the debt, therefore acknowledging the debt.

    Ok, do they have a copy of your credit agreement? I'd try that as well, make a nuisance of your self.
