Collision at Garage Forecourt
A friend was involved in a minor collision this morning. Her car was stationary and another car hit her door when she opened it. Happily no one was hurt and the car only has minor damage but was wondering if anyone could tel me who was responsible in this situation?

cant say it could go 50 50, its a drivers responsability to ensure he drives with care and attention.
if your friend opened the door a nano second before impact then i would say it was your firends fault for not checking the way was clear before disembarking the vehicle.
ive had this happen to me, at least once a week someone will park at a pump closet to them and not move forward to the other one for the vehicle behind to use, so you have to slip around them to use the one ahead of them that they could have used upon going round a passenger will decide to get out and almost hitting the car and look at me as if someone forced sour grapes down their neck and how dare i pass to the other pump they so graciously didnt give a toss for curtesy to move forward an extra 10 feet ahead to use themselfs.
its the same on school run, kids wounder out, door open like missile's and it looks like a scene from a world war 1 film where the front line are trying to advance into the enemy trenches, with mortar fire landing all round except its modern day and the mortars are kids and cars and you just trying to navigate the traffic.

At least it'll have been covered by CCTV and be pretty obvious what happened.0

If the door was opened and there wasn't time for the driver to do anything about it then I'd say it was your friends fault.
If the door had been opened before the driver got anywhere near then I'd say it's the drivers fault.0 -

Insurance wise it's likely to go 50/50 unless there is very good cctv evidence etc to say otherwise.
The offence you refer to specifically states "On a road" rather than "On a Public Highway"0 -
Thanks for all the replies. She has been back to the garage and it was caught on CCTV. The staff there said that the other car was going way too fast. My friends car actually lifted a little on impact.
Guess it will be up to the insurance company to sort out then.0 -
