Just wondered if you all agree with me sending the letter proposed by Hoohoo above and shown below here or do I simply ignore them completely?
Dear xxx,
Further to my previous letters and following advice from moneysavingexpert I am writing to inform you that I will not be providing further details or corresponding with you again. I require you to contact me with a final decision regarding your appeal process within 35 days of the date I originally contacted you. If you do not cancel your invoice, I require you to provide a POPLA code. If you fail to reply within 35 days you will be deemed as having cancelled the invoice.0 -

Hi All,
Well after hearing nothing since I wrote to them with this text below (saying if nothing heard within 35 days I would assume it as cancelled) they have now replied some 5 months later with a POPLA Appeal Form with a verification code on the bottom.
What do you suggest I do with it?
Reply or add it to my pile of toilet tissue?

What's the timescale for lodging a POPLA appeal - 28 days?
Mind you, I'd be tempted to use it just to hear how they try to explain away the five month delay!

I would appeal to POPLA as this breaches the Code of Practice Parking Eye signed up to.
I would also complain to The British Parking Agency and the DVLA about such a blatant breach.0 -
As I parked in the car park for longer than I was supposed to and therefore I am at fault should I still appeal?
If so I'm not really sure what I can appeal about as I did not pay the required fee.
The only options to tick on the POPLA appeal are:-
The vehicle was not improperly parked
The Vehicle was stolen
The parking charge exceeded the appropriate amount
I am not liable for the parkign charge
Any help would be appreciated?

In order to enforce this Parking Eye have to abide by the Code of Practice. The CoP states Parking Eye have a MAXIMUM of 35 days to either accept or decline your appeal (CoP point 22.8)
The BPA in the code say there should be strict compliance (Para21.5). They have failed to do this.
You are therefore not liable to the charge and should appeal to POPLA.0 -

Don't ignore it as Parking Eye love to serve court papers. I would just flesh out what I've put above plus a top tip with Parking Eye is to challenge their contract.
Put in something like "I do not believe Parking Eyes contract gives them sufficient authority to bring legal action and I wish to see their contract with Welcome Break" This is contrary to sction 7.1 of the CoP.
Parking Eye so far have refused to show their contract to POPLA and I haven't seen anyone lose an appeal where this has been brought up.
So In short appeal due to timing issues and lack of landowner permission - I've put the CoP numbers there for you to quote. Doesn't need to be a long appeal just add a little bit to my points.0
