    Depends how you define legal, is it a crime to post a sign threatening something you can't actually do ? IDK !

    How many "Tresspassers will be prosecuted" signs have you seen ...but tresspass (non aggravated) is a civil tort not a criminal matter ...so no prosecution is possible.

  • According to the BPA, any sign that is for clamping/towing must be removed by 30Sept this year. But as they are not on BPA AOS or probably not a member of BPA there's nothing that can be done. TBH the BPA don't even want to know when they are members. I don't have any idea who to complain to but a mail to DTV reminding them that clamping is now banned would be a start.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

  • Since clamping is now illegal, I'd be carrying a set of bolt-croppers to remove any clamp were it fitted.

    Sec 3(1) Criminal Law Act 1967:- 'A person may use such force as is reasonable in the circumstances in the prevention of crime,...'

    Unless on a railway (trackside) or airfield (airside) of course :beer:

    I'd say it's quite legal, albeit out of date!

    If I put up a sign which says "park here and I'll drop litter", am I committing an offence? In general it isn't illegal to threaten to do something which is itself illegal. There are exceptions - it is illegal to threaten violence or criminal damage for example, but AFAIK nothing which clearly applies to clamping.
