  • From memory, a nikkah performed abroad is considered valid, but one conducted in the UK is not considered valid without an accompanying civil ceremony.

    I'd suggest talking to you students union / university finance department. These support services are there to help you.
  • I get the feeling i have committed the biggest fraud in the history of student finance. :eek:
    A person knows when he is married and when he is not married. Its like declaring a engagement and marriage is the same, it is but then again it aint.
    I should of asked if i was not sure but i was sure that i was not married, if you know what i mean.
    Even though if have committed a genuine mistake, its too too harsh. Most people will understand why i did what i did.

    In your original post you said that you got married in 2007...so you can understand why people would think you were married?

    For most people *being married* tells them whether they're married or not...it's quite black or white.

    For someone to have "got married" but then write "single" on a form seems a little odd, but it sounds like an honest / cultural misunderstanding, so I'd be surprised if they stick to their decision.

    I wouldn't be surprised.

    You'd have surely stated you were separated/divorced, not single.

    The nikkah is not acceptable documentation, and a formal marriage certificate is required by SFE.

    I really do not see them overturning the decision.

    So if SFE do not regard a nikkah as a valid marriage, that means that he acted correctly when he wrote that he was single on the form. In which case it is wrong to sanction him for providing incorrect information.

    I think there are two separate issues to discuss: whether or not he was married in terms accepted by SFE, and so should have described himself as married or single when he applied for funding; and whether he lied when filling in the form (so that funding should be withdraws) or made an honest mistake (in which case the amount of his funding should be adjusted to reflect the actual situation, rather than withdrawn). Both issues deserve thought, but we should not conflate the two.

    Just because the documentation isn't acceptable, doesn't mean that the marriage would not exist.

    A student who is married, but chooses to live apart from the spouse without an intention for divorce, would come under the Married tag, not separated.

    I can see where the honest mistake part will come into play, but I don't forsee SFE changing their mind on the decision here.

    A Nikkah performed in an Islamic country is considered to be legally binding as you would have to file for divorce when residing in this country... So SFE accept them as proof of marriage

    I'd suggest talking to you students union / university finance department. These support services are there to help you.

    A Nikkah performed in this country is not legally binding and requires nothing to divorce as it is not a legally marriage on this country...

    I don't imagine that SFE will change their minds as there is a little disclaimer saying to your knowledge all the information on the form is correct... So if I accidentally hit the wrong house number of put the wrong year for an old qualification than I'd imagine I could argue my point - but I have to agree what made you suddenly change your marital status if the documents were dated 2007 how did her moving to the country suddenly make you decide you were married rather than single what changed? You either thought you were legally married in this country or you didn't...

  • I have put in an appeal, just had one question I phoned sf and they said the special investigations unit are still investigating my account further, does this mean that they can change there decision????? Or are they trying to look for other things????
    Sorry final question, I have not yet received a letter or a email stating why they have stopped payments and no explanation, they have told me over the phone but not in writing, when will I receive it in writing, there are letters on my sf account but these are just letters stating that my eligibility has changed. Do they send letters or emails.

    Then provide them with the civil docs from 2011 and say you just got married - why did you even send the docs from 2007 if they are not legally binding?

    I have to say I can see their scepticism at a wedding process that takes four years to complete.... Surely if this were the case they'd come across it more often and have ways of dealing with what must be a confusing period for many Muslim men where they are embroiled in a 4 year wedding ceremony... (How can it take that long to complete I thought any Muslim man of good standing could perform the ceremony? There must quite a few of them in knocking about...)

    Is it the 'norm' for this process to take 4 years????? What box was your other half ticking on forms? And what proof was she using to evidence this?

    I can't see how you were ticking 'single', and then suddenly 4 years later 'remembered' you were married. Look at this from SFE's point of view they must come across a lot of people trying to fiddle the system, and changing your marital status 4 years after the marriage ceremony began has rightly set of alarm bells...
