But does it matter if it has or it hasn't? He is not using it or nor has the ability to reclaim it, rendering the phone 'stolen' or missing at least. It's the same if you claim you've 'lost' your mobile in the back of a taxi on a drunken night out. They block the sim and send a new one out with existing number to carry out the remainder of the contract.0

You appeared to be using it to justify your advice - if it's not relevent why did you state it twice?
As the same person has been using the phone for a 8 months or so, it will likely be obvious to the phone company that the phone has not been stolen (from regularly phoned numbers), or lost for that matter. Although whether or not they'd check I have no idea.
Is it a breach of contract for the OP to have taken the phone out in his name and then given it to someone else to use? Naively, I'm not sure it is? If it is not, then I don't see why the OP should not simply tell the truth?0 -
