Brought item from USA. Fell apart in wash. Refusing refund?

I wonder if someone could advise me.
My wife brought 5 bras from the USA for $30 including delivery from Ebay. These seemed a bit too cheap and when they arrived they seemed okay.

She washed them before wearing as per the label which said a cold wash. When they came out the straps had all detached from the bra. It looks like there was very thin thread holding them on.

I contacted the seller who told me they won't accept returns if the items have been washed. So I opened a case in seller resolution and explained that they had fallen apart in the wash even though they had been washed according to the label. I asked for a full refund.

The seller responded again saying they won't accept returns once the items have been washed and to be more careful washing items next time!!!

I responded again saying they were washed as per the label and are of very poor quality and not fit for the purpose.

The seller responded to this saying it was my fault for washing them incorrectly and they refuse to refund.

I just wondered where I stood regarding it being from USA? The item itself was about £10 and the rest was delivery but it still a lot of money to spend including delivery. Do I have the same rights to a refund as its from USA?

If you bought from a US site then your rights will be different as the UK DSRs will not be in force. Is there any protection offered by the website etc that you used?

In that case open an SNAD claim and state goods not as described as they fell apart after a single wash (you followed seller instructions)

Some bras have detachable straps so they can be strapless or not as the situation requires. Have a look at how the straps were held on. If there are small loops on the top of the bra and on the back, and the straps have hooks on the end, they were meant to detach all along. If the fabric has sheared off, you will be in with a chance of claiming SNAD/faulty.

Good point, most of my La Senza ones detach in the wash as well and have to be re hooked.

They do attach to a loop. However the loops have all broke while being washed so its impossible to put them back on.
  • Bear in mind that if you win the dispute you will probably have to return the bras back to the seller, and you will need to do this by a method that ensures tracked delivery.
This will take a fair amount of the refund that you receive (around £19 or £20).

OK - great - that would be SNAD :).

I would take a close-up photo of the label and upload it to your SNAD claim, with a covering explanation, detailing that you expressly followed the instructions.

This will make it visible to the seller and eBay - hopefully it will help.

This is what I am worried about. It seems quite unfair that I am pretty much stuck with losing my money regardless of the outcome. Will make me think twice in future about buying from USA. First time I have had a problem.
