Parking Eye - Crown Wharf Walsall

Hi there!

My Mom has just received a "Parking Charge Notice" from Parking Eye. We were at the Crown Wharf Shopping Park in Walsall last week. We decided to go to Frankie and Benny's for lunch and were there for 2 hours 15 minutes in total.

We didn't realise that we had to pay for parking there and my Mom is a disabled blue badge holder, which made us both assume that parking would be free! We parked right outside Frankie and Benny's in a disabled parking space, as my Mom is unable to walk more than 100m.

I phoned up Crown Wharf this morning after my Mom had received the letter and they said that disabled people have to pay for parking.

We now have a charge due for £85 (£50 if paid by 22/11/12).

What are your suggestions? Just ignore? Pay the charge? Appeal?

Thanks for taking the time to read this.

Just throw it in the bin - you will get a number of increasingly sinister letters that make it sound like bad things will happen but they are just hot air. You might get five or six of those and then they will stop.

If really want to kick up a fuss, get in touch with a local paper and say how Crown Wharf Shopping Park gets bullies to send sinster letters to disabled people even after you realised you had made a mistake and phoned them up to discuss the matter - local papers eat up stories like that.

Bin it and ignore any threatening letters.

Then get your Mother to read the handbook that came with her badge ot the issuing authority website. It makes it quite clear that the Blue Badge Scheme does not apply on private property.
  • Discard it. The demand is unlawful, doesn't matter that it may have been correctly issued according to their own rulebook. What matters is Contract Law and this legislation says the landowner can push for losses, so the maximum fee could be the price of the ticket purchased, not the ParkingEye fake invoice. Either way, don't even offer that, they have chosen an unlawful route. Ignore them.

Ah, Parking Eye !!!! Ignore them. They cover my local Aldi car park and I regularly break their "rules" and then send them an email baiting them. Strangely they don't seem keen to send me an invoice - I suspect it's because they know I know that it is unenforceable :rotfl:

As others have said, it really is easy to ignore this scam.

    1. Read the sticky thread, 'PPC letter chains' and look at the preview pics of the rubbish debt collector letters you'd receive.

If unsure how to see the forum index (stickies at the top) see my signature. Just one click gets you back to the forum index of threads.

    2. Check out which standard letter templates will come next.

    3. Watch this Watchdog clip; the only thing that's changed since this youtube clip is that they no longer need to know who was driving and - if they have reasonable cause - they 'can' send the letters to the owner/keeper - who 'can' still ignore them!:

    4. Ignore the scammers and tell your colleagues/friends and others in your family about this con.

Unfortunately this is a pay car park, not free for first X minutes or hours.

So you should pay the charge for parking - £3.

You can ignore it as Parking Eye do not do court but the landowners do have a case which you could easily rectify by sending a cheque for £3.

Yes but PE will not accept it so don't send it to them!

If ParkingEye were acting lawfully, yes. Since the entire nexus only intend to scavenge for every penny via illicit methods, they won't be making a claim whereby they merely seek loss - in which case, nobody needs to offer a penny.

    Very good point
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • Re Parking Eye Borehamwood Retail Park

I have been reading the threads for advice and sent PE a proforma letter from Martins website refusing to pay under ground signs not lit at night and exorbitant fees ( 85.00 for being 10 mins over)
However I am losing faith as I have just seen one of the leaflets in their response letter stating the laws have now changed in favour of Private parking companies, who will now be able to claim the charge, the new legislation came into effect 1 Oct 2012

    Anyone hear about this?

    Getting Worried!
    thanks
