Yes you can ask them to cover any costs you reasonably incur due to their breach of contract.
However you do have a duty to mitigate your losses, so as above, keep it reasonable/to a minimum, borrowing a car instead of hiring would be a good example of mitigation
Personally I'd write and ask them to collect the car within 7 days.
Whether you can claim for insurance or not is debatable and dependent upon what kind of policy you have. If you're covered for driving other peoples cars or just your own. Breakdown cover....again does it cover you or the car? If you then you have no claim imo. If its the car, then imo your reasonable loss in that case would be whatever it will cost you to cancel/amend the policy.

the car is on my drive, the handbrake is totally u/s, will cost at least 300 to put right.
i offered to accept £250 less than i paid them for the car, and would wait until i sent them the v5 for the balance to be returned to me but they havent responded to me.
obviously whilst in my care the car is insured by me ( at a cost of £60 per month) and taxed by me and covered by recovery by me. i havent driven it since tuesday of last week.
re the warranty, itwas added onto the cost of the car, and in the warranty booklet it states that the warranty is between the policyholder (my details are shown as the policy holder) and warranties direct who provide the warranty.
it seems to me that until i receive a refund the warranty should still be in place. the dealer has cancelled the warranty to save money.
my worry is that i have to get the car back to the dealer, if the engine fails on that journey a replacement engine will cost well over £1000 plus fitting. and if the garage wont pay £300 to fix the brakes i cant see them paying for a new engine or gearbox.
One very very last point, with my job i work from home and travel around the country doing approx 18 to 20,000 miles a year, next week i have to go to the west country for 3 days and the week after i have to go to kent for 3 days. a total of around 800 - 1000miles.
I dont want to add any miles to the car, and i wont be doing but
do you think it fair for me to hire a car and charge the seller for these business trips.
just wondering if that would make him change his mind about making me wait for a refund. i will probably have to lend my partners car, which means i will have to pay to be put on her insurance so that i can drive it on fully comprehensive.
Re the other problem car that i bought, it was only resolved because i threatened to get the work done and then send them the bill. we then came to a settlement.
however, when i bought the car, they told me it would come with 2 keys, it was a new shape passat, the keys are over 250 including programming by a main dealer.
the invoice for the car mentioned it being supplied with 2 keys.
trading standards called the dealer and the dealer told them that they never supply 2 keys with a car, and it was an error on the invoice.
i never received the other key, thats why i would rather just get the brakes fixed on this one, i wonder how many other people give up and dont bother pursuing dealers.
I wouldn't want to own a car I didn't have both keys for - have you checked this car is HPI clear?
There's something very suspect about the keenness to refund, almost like they are afraid of you finding something else.
Personally, I think you are being far too generous, especially with the original sold as seen idea - seriously these things are expensive and you have way more rights over this than you're potentially using...
If you want to invoice them for the hire cars etc, I would inform them of this in advance...0 -

OP talking about 2 keys was referring to a previous purchase that they made and had a problem with. Not the same purchase he's asking for advice on now
