First Capital Connect Accident

Hi All,

I'll explain my story,

Back in January and with my ex girlfriend, who lived at Brookmans Park Railway Station, I went to visit her one day as a BF does, and i traveled by FIRST CAPITAL CONNECT now this station was icy and NOT GRITTED, on a day we had snow; and i basically walked up the footbridge tripped and heard a crunch and i had broken my toe as my ex girlfriend is a nurse and managed to tell me it was a legitable break now i rung NO WIN NO FEE, the day of the accident and told them what happened and im in touch with a solicitor still, and today i get a letter from my Solicitors saying First Capital Connect DID NOT grit the station and that THEY ARE AT FAULT! but they still won't pay out, what do you think will happen next?? and how much am i likely to get the solicitor costs which First Capital Connect have to pay are currently £24,000

Hang on - if FCC are refusing to pay out that suggests that they are denying liability and that the case hasn't yet been to court. That will be the next step if so.

I'm astounded though that they can rack up £24,000 in costs just getting an opinion from a lawyer that FCC are liable, which is what it sounds like.

What if anything you have to pay depends on your contract with the solicitors - on the face of it nothing but there could be some weasel wording in there

Sounds like it is your ex girlfriend's fault!

Another example of the compensation culture gone mad. What expenses have you incurred as a result of the broken toe (I trust you are not a toe model?), and what has the solicitor been doing to rack up such high costs?

Your solicitor has told you that FCC did not grit the station. Your solicitor has said that they are at fault.

From the looks of it, FCC has told them where to go!

Given that Brookmans Park is - most of the time - an unstaffed station, would you really expect it to be gritted the instant there is a trace of snow?

op is barely coherent, but uh £24k in costs? How has that happened?

Surely if it's no-win, no-fee, it's irrelevant to you?

I've been to other FCC stations, not Brookmans Park and they have ice indicator boards outside the station warning of icy conditions. they look like a giant snowflake on a board. If they change colour it is a warning to you to be careful. it may be that that is sufficient to warn you of icy conditions in legal terms.

A) My ex lives near Brookmans Park Station

No Ice Board

C) Reason for high fees is due to the fact they have had to do medical tests, letters, court fees.

Did you really need a warning board to tell you there was snow on the floor?

What medical tests did you need for a broken toe?

You failed to answer the earlier question - what costs have you incurred as a result of your injury?

You tripped and it's somebody else's fault? So jump on the No Win, No Fee bandwagon. Heed what CAB says about that though....

You should think very carefully before entering a 'no win, no fee' agreement as, win or lose, you may still have something to pay, and this can often be much higher than you might expect.
