The tests i have had to do, the solicitor that i have got sent me to a private health care place, to get it examined after a 3 weeks from the incident; which most of incure costs and yes they have had a pre hearing review; and i'm just saying it must be the snow that must of caused the incident, how else would i trip and break my toe?0

People trip every single day, it's called having an accident.
A one off medical examination would have cost at most a few hundred pounds. I'm guessing that they didn't find a great deal of damage, given that you went on holiday in early February?
Given your refusal to respond to my question about your incurred losses, I'll assume the answer to be none.0 -
Missed a few weeks off work?0

Not necessarily.
And in any case, the loss that you suffered from a broken toe is unlikely to be valued at more than a few hundred pounds. If things get to that stage, you would still owe your "solicitor" their expenses, and by then you would clearly have agreed to pay these fees.
No-brainer really.0 -

You took a few weeks off work for a broken toe? Your profile shows you are a student and a travel agent, which required such effort with your toe?
One wonders how you were well enough to go to Tenerife ...0 -

That's all you are bothered about isn't it - the fact that you had no losses (your previous posts imply you were not working at the time), you cannot prove that the lack of grit caused the accident - all you want to know about is what money you might get.0 -
That's technically not true Duck; but surly if a station is not gritted and i slip and fall who's mistake is it?0

What is not true? It's pretty clear you have lied about working at the time.
On the information given, it is impossible to say who was at fault. However in most trips, no one is at fault, they are accidents. Would you be suing if you fell when there was no snow?0 -
You seem to have missed my earlier post...Neilandrewhall wrote: »...surly if a station is not gritted and i slip and fall who's mistake is it?Are you sure the train company has an obligation to grit?
I know that there is no obligation on me to grit my front path, but if I do do it, I have to do it with care otherwise I can be sued, should anyone suffer.
You also appear to have overlooked the quote from the CAB in post #12.
It's so important, it's worth repeating...You should think very carefully before entering a 'no win, no fee' agreement as, win or lose, you may still have something to pay, and this can often be much higher than you might expect.0
