I have been going through my finances over the past few months and found that the DWP 8 years ago stopped making payments on a benefit I was receiving. At the time I assumed that it was because I had failed a medical. Only when my file from them was received did I realise that there was a problem with the decision notice.

I actually have never had the decision notice and the file proves that it was sent to an address that I had lived at years earlier.

I contacted the DWP who accepted that that was their error, and said that a few weeks later another decision notice was sent to the correct address. I pointed out that I had never received it and there is no copy of the second notice in the file.

The answer came back that it was posted, we don't have to have evidence to that effect and it is up to the claimant TO PROVE THAT THEY NEVER RECEIVED IT!!!!!!

So it seems that the claimant has to prove posting, but not the DWP. Nice one.

PS. still to this day I have not received any formal notice as to why the benefit ceased in 2004.

  • Check how long the DLA award is for. My Sons award goes upto age 16 and was initially over the usual 3 year award.

If I was in your shoes OP I would also be considering home tuition. I could not bear to see my Son so unhappy. In the meantime have a look around for specialist schools. I know some parents in my local area are considering starting their own school for autistic children because the parents feel the present system is just not good enough so see if anything is happening in Brighton.

Also make sure you tell Tax credits his exact award of HRC and LRM as you will get higher tax credit award than MRC and LRM (I didn't know this so lost out on several months money as they do not backdate for more than a month), Tell them now about his DLA award if you currently get Tax credits.

I wish you all the best and hope it all works out for you both.

To be honest, unless you are over 65, you will be assessed for PIP next September. Given your view on how that assessment will work out I would be keeping everything crossed until then and not 'rocking the boat' in the meantime. You could very well find that if you asked for a review of your DLA, they may well remove some or all of the current award.

Given their current attitude, anything is possible.

Are you going to apply for PIP? If so, I would seriously be getting your evidence together from now on.

I get HRM & MRC and given the PIP descriptors I will lose both and come away with nothing! Hence, for me, I don't intend putting myself through the agony of trying to claim for it.
