ASDA parking charge for Mother and Child area
wotel
Any thoughts on this please:
Wife drives to ASDA to shop and collect waiting 6yr old Grandson from her son. Parks in Mother & Child 'slot' in anticipation - leaves expensive childseat in boot of car.
On return finds a PCN from TCP under windscreen wiper. No TCP agent in vicinity. Wife fits childseat. loads grandson and returns home extremely upset. ASDA denies any involvement with TCP #apart from them acting as agents#.
Question: What proof would TCP have in any court hearing #assuming I ignore their demands# that an 'offence' had been committed. Do they have photographic evidence to back their claim?
Appreciate your thoughts and comments - apart from notices, the ASDA carpark is 'free' to all users.

It's easy, ignore this scam. Who cares about photos, it's not a fine and will NOT go to Court. It will move on to junk mail, that's all.
Like all the other posters on this board, your family has a fake PCN. What makes anyone think it would be OK for Asda or their agents to 'fine' their customers?! Of course they can't!
The registered keeper must just ignore it and ignore the other letters that will arrive. The letters are easy to ignore and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.
The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.
There is no fine, no CCJ, no bailiff, no debt, no effect on credit rating, no Court, no repercussions at all from a pathetic, unenforceable fake PCN (= invoice) issued by a random third party.
This is a third party and neither they nor Asda can fine anyone at all, legally. You should be very angry at this threatogram when the driver/passenger were Asda customers!
COMPLAIN IN WRITING TO THE CEO OF ASDA AS THEY ARE RESPONSIBLE FOR THEIR AGENTS ACTIONS.
Tick off the threatening letters here.
Watchdog clip with expert Solicitor's opinion here.
Barrister's opinion - read the answer at the bottom, it's very clear! - here.
As for the fake PCN and TCP, just play snap with the threatograms from debt collectors - choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What proof? None. It is a fake invoice you have been given, totally unenforceable and given your real circumstance - even the judge would come down on your side. Not that you'd need it, the charge they seek is a de facto penalty and therefore is 100% illicit. Landowner losses are zero.
Step one - let them wait, let them BUY keeper details from DVLA. You are justified in not acting because there is no proof the ticket was there when your wife returned, I may have ripped it out.
Contact them and you'll cut this out and give them a face. Let them do the chasing and they don't know A from Z. They won't know if they are going after right person either.
If a POPLA appeal system becomes possible, I recommend go down that route just to make your antagonist pay even more money for nothing.0
