Parking Charge Notice

I recieved a parking charge notice from New Generation Parking for £100 or reduced to £50 if I pay within 14 days. I've read the other posts and I'm confused what to do.I have no intention of paying up yet. But I don't know if the best approach is to appeal or should I ignore and see what happens. The new parking legislation which came into force in Oct has confused me , does this give them the right to pursue me for the "debt" as they are a registered company.I was parked in a car park in Talbot Green, S .Wales which is a retail area. I am not familiar with the area and was unaware that it was a private car park as the sign stated "free parking" and in small letters it said 30 mins max stay.My details were kindly provided by the wonderful DVLA.
Any advice welcome.

  • Scammers.

    Ignore them.

I assume the car is registered in your name re: DVLA mentioned in your post.

The new law means the you as 'The Registered Keeper' ignore them rather than you as 'The Driver' ignore them. Same result - they don't get to steal any of your money.
'Parking tickets' issued by Private Parking Companies are not 'parking tickets' at all. They are unenforceable invoices as stated by MSE head Martin Lewis recently on TV.
My family and friends now know what's going on in private car parks and motorway services areas. :T

I would have liked this section of the NGP website if they had been able to spell and if they had actually named and shamed some recent perpetrators of BPA Code breaches:

    http://www.ngpltd.com/nameandshame.html

''However, there are individuals in the Parking Managment Industry that are not interested the rules laid out by the governing bodies that regulate us, and will continue to take money ILLEGALLY from members of the public unless something is done.''

    :rotfl::T:rotfl:

But no, they've got a pathetic link to an article about 'Citywatch clampers' from nearly 3 years ago. Hmmm...and their FAQs link leads to no FAQs at all!

Anyway rueyD, don't let the new Act confuse you - it has NOT suddenly made unenforceable fake parking 'tickets' somehow magically enforceable. It just means they can send their letters to the registered keeper who can ignore them just like drivers do!

Or if this was in England/Wales since October 1st, you can appeal which is fine - but you ALSO MUST then appeal to the second stage which is POPLA. There's loads on this forum about POPLA but it's new and untested - you'd only use that to cost the PPC money to fund the POPLA appeal! You can still ignore the outcome as it's only binding on the PPC, not you.

If you are unsure then ignoring is still a good plan for you. :)

The letters are easy to ignore and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

There is no fine, no CCJ, no bailiff, no debt, no effect on credit rating, no Court, no repercussions at all from a pathetic, unenforceable fake PCN (= invoice) issued by a random third party.

Tick off the threatening letters here.

Watchdog clip with expert Solicitor's opinion and a fake PCN like yours here.

Barrister's opinion - read the answer at the bottom, it's very clear! - here.

So I recommend he/the registered keeper just plays snap with the threatograms from debt collectors - choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority.

HTH, your choice...are you an appealer (then ignorer) or an ignorer from the outset? Just DO NOT PAY!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Well Ruey, they can legally seek losses but they may not seek a penny more as this amounts to an illegal penalty.

So what is the loss? £100? Why then if I may be so bold as to ask are they giving you a 50% discount?

...or is it £50? If so, how do they justify the wild overnight jump to £100 unless what you have is nothing other than an arbitrary penalty!

I am guessing that losses are probably zero in your case. Changes from October 2012 have not legalised the issuing of private PCNs so you relax.

"we are a approved operators of the British Parking association."

    Says it all
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
  • "we are an approved operator of the British Parking association."

meaning: we are members of an elite powerless unofficial club with no authority, no backbone, and no structure, but we attend the end-of-year drinks session!
