I am just writing to ask for my charges back from HBOS.
Two questions.
HBOS's registered office is in Scotland. Their small claims court is limited to a £750 maximum as opposed to the £5000 limit for English small claims courts.
I live in England and my branch is local to me. Do I go for an English small claims court. I am asking for more than £750 to be repaid. Or as HBOS is based in Scotland do I have to take them to court there?
Has anyone been through the whole process with HBOS. Are they likely to put up a big fight or do they make offers. The thought of going to court scares me, but I will do so on principle if they refuse to repay the charges.0 -
As you live in England you can use MCOL and file under English law and at that stage use the Halifax address rather than the Edinburgh address.
The HBOS thread has been mixed up with the Halifax thread and I am trying to sort that one out at the moment and will get these posts into the thread once I have but you will find success stories there for sure, good luck.0 -

I'm suing the RBoS using their Scottish head office address.
The clerk at Stockport County Court looked it up and said all was okay but I had to add "No proceedings between the parties concerning the same cause of action are pending in the court of any other part of the United Kingdom and the defendant is domiciled in the United Kingdom" to the end of the claim form (which I might add was neatly typed and I had to put my scrawl of a handwriting over it)
Apparently this is to prevent the claimant suing the defendant again under Scottish Law.Hamsters have no tact and diplomacy, nor do they want any.0 -

I am in the same position as yourself. I posted a letter to BOS 2nd March 2007. They cashed the cheque 5th April. I phoned my branch this morning who were very unhelpful. I then phoned their general enquiries who gave me another number which is a recorded message saying if you are query is related to data you should recieve it in 40 days. On our original letter template it says I will seek help from the Information Commissioner. I have looked at their site and I am a bit baffled what to do there.

Hi, i still haven't recieved my bank charges. Bank owes me £5300. Bank is not paying up so i have went through the fos. They are investigating my claim at the moment. This has been going on since 3rd March:mad:0

My claim against the BOS is also with the FOS. I first asked for my statements on 16th Jan. and asked for refund on 19th April. BOS declined so I passed my claim onto FOS on the 15th June. Received a letter from FOS on 10th July, saying that they had written to BOS to either pay up or send them all info. that they need to resolve the claim. Still no result, nearly 5 weeks later, hope it's not much longer!!
