Vodafone price increase dispute

Hi all, new to the forum so be nice ;)

I've been emailing Vodafone for about a week now rgfarding the price increase. The short story is basically they have not informed me of the price increase. Any excuse to get out of the contract, I jumped at this as they're T&Cs state they will give at least 14 days notice. I have sent a few emails back and forth and they've offered me a free contract upgrade, I've persisted and said I wish to cancel it without the early termination fee as they've breached the contract. They've now offered me to not have to pay the price increase, with the following response:
I have checked the trail email and understand that you are unhappy with the recent changes in your priceplan. I completely understand that as per the terms and conditions, it is our responsibility to inform all the customers. We would like to inform you that the bulk messages were sent to all the customers whose priceplan was getting impacted due to recent change. It might be possible that you did not receive the text in case you were out of coverage area or due to any technical issue. However, the change is applicable and as per our policy we will not be able to cancel the contract without any ETF (Early termination fees).

As you requested your number to be moved to PAYG, we have scheduled the account to be moved to PAYG a day after your contract end date which is 9/09/2013.

Also one of the colleagues has already committed that they will reverse the charges to nullify the change by adding a recurring discount of the amount by which the change will happen till contract end date. So, your current priceplan will stay and there will be no increase. If you accept the offer then get back to us and we will apply the changes. This has been offered to you as an exception and has been made to you as “one-off” case.

We would appreciate your understanding in this matter and look forward to an agreed resolution.

My question is, where do I stand with this? An I within my rights and I should keep persisting? (This is a response from the manager as I requested it be escalated) or should I take the deal? I ideally want out!

Thanks :)

as they do not now intend to make an increase, they have not changed your existing contract terms. You have, therefore, no reason to cancel without ETF

Keep their email, however, in case they do not automatically move you to PAYG next September.

Is this really how it works? :(

So if I don't pay my bill and they charge me and then I pay it, I can say there's no reason to charge me as I've paid it? :P

So basically you think I won't get anywhere by persisting and I should give up? :(

    Thanks :)
  • Having been in a similar position and been "persisting" for 6 weeks now, I would save your energy and take what they are offering to be honest.
Whatever positive result you get, even if it means having to take them to court to reclaim an ETF charge, will probably not be enough to cover the time and effort you'll need to win a case against them.

Guys Dad, where did you learn that they are now not intending to make the price increase? I've heard nothing about this...

Unless I'm wrong, I believe that this was reference to the fact that VF have decided to give a credit to xnemesis equivalent to the price increase.

Yeah that was their solution to failing to keep up their end of the legally binding contract ... £0.95 credit a month! I think I might take them up on the change to Vodafone red tarrif then if I won't get anywhere without full-time investment of time! :a

    Thanks everyone :)

The reason you have no case is this. Allow me to quote from the email you received from them

So, your current priceplan will stay and there will be no increase
    .

They further said "This has been offered to you as an exception and has been made to you as “one-off” case."

So, following your complaint, they have reverted to the status quo and taken away the increase, leaving you no worse off than before.

You are now trying it on - quote "Any excuse to get out of the contract". Well, you got a victory with the cancelled price increase so you should be satisfied. You are now just being greedy.
