Hi everyone. Well we had my sons appeal tribunal today and we won. He was awarded MRC back after it all being taken away back in May. There was a DWP representative there and he was really lovely. He said that he thinks we should be back in payment in about 4 weeks but im not sure if he knew fully.
Does anyone have experience of how long after the appeal has been won that they put payment back into place ?
Thankyou

4 weeks possibly the right timescale - it just depends on how busy the DWP dept dealing with his award is. Then again, it could arrive inside 2 weeks. Make sure they have up to date bank account details, just in case.0

My daughter won her appeal for DLA at a tribunal. It will be 4 weeks this Friday and we haven't heard anything yet, although I did get the decision in writing after the actual hearing. I was thinking of phoning tomorrow to ask about it.0

I have called Tax credits and they said I am entitled to the disability premium back pay too, when his award was stopped we went from Carers Allowance and IS to my partner having to claim jobseekers. Due to a lack of work by partner is going self employed as a DJ and im aware im able to claim carers allowance back but does anybody know if that will get backdated.
Next year im going to be setting up self employed myself as im a professional photographer.0 -
I thought it was 3 months back that you could claim carer's for. I may be wrong though.
Well I phoned the DWP about my daughter today. Her tribunal was on the 12th of October, and they said that as far as they were concerned her appeal was over as they sent us a letter on the 16th of October. I told them we hadn't received it. She is also entitled to getting the MRC backdated from the beginning of January and this hasn't been paid either, even though she already gets LRM and they already have her bank details. In fact she got a payment this week and it was only the LRM that was paid in, no sign of the MRC.
They said they'll notify whoever sends out the letter that we didn't get it. But even if the letter had been sent out, surely they would have just paid the back-dated middle rate care payments in to the bank, especially seeing as she already gets low rate mobility DLA?
If I were you I wouldn't leave it longer than 2 weeks if you haven't heard from them by then.0 -
You normally get a form to fill in before you get any back payment, the form is about hospital admins and once you send that back you get the money pretty quick.0

Ive been told I will get backdated carers allowance from 11th June. I cant get anything though until DLA is back in payment which is a bit of a pain.
What sort of form do they send ? What do they ask ?
I phoned them this morning and they have the decision back and they said if the decision maker agrees then I will get a form to fill in. What do they mean by if a decision maker agrees ?? I made myself physically sick worrying about this appeal and I thought it was finally over. Why does a decision maker look at it again ?0 -
I have also been told I will get tax credits disability premium backdated to June. Is that correct ?0

They can, as you can - appeal the decision of the tribunal if it has made a mistake in law.0 -
Hi,
Been reading this and just wondered if you had received a payment yet? I won my appeal on 25/10/12 for low rate care to be backdated to 4/4/11 (yes 18 months to go to appeal!!!!) it's been 2 weeks since the appeal and I've not heard a thing and am also waiting on IS to pay the disability premium as well?
So was just trying to work out what the time scale was in getting money backdated? And if I will get it this side if Xmas or not?
Thanks in advance.0 -

I was half expecting a letter today because I phoned to chase it up last Wednesday, but there's nothing yet. It's 4 weeks past Friday since my daughter won her appeal. She has been told she'll get it backdated from January.
The DWP told me they'd send out a letter to us 4 days after the appeal, but we never got one. If I were you I wouldn't leave it too long as they might've overlooked it.0
