Help please

Please help I purchased a DS from a seller on ebay her profile said she was based in hongkong but the item was coming from London and was also in UK format.
I recieved the item in the correct time but when opened it was in Chinese format and it had come from HongKOng.
I sent the seller an e-mail explaining and she appologised and said she would send me a card with 130 games on it for free which I said was fine.
I have today recieved a pro-forma invoice for 29USD....!!!!! I think its custom charges or something not sure really. I am really upset about this as that is so much money (£80.00) and it is for my daughters birthday.
I have now asked for her to arrange collection of the item at her cost and to give me a full refund as the item was missold and she lied by saying she was in London and the item was in UK format.
I have never had any problems with ebay before so I have NO idea what to do, what my rights are ect.
I would really appreciate some advice from people who know what is what.

    Isnt 29USD closer to £20? Just being pedantic really, i thought the exchange rate was £1-1.5USD?
  • I read it as the DS cost £80 and the customs fee was 29USD :)

    No idea about customs fees as rarely buy anything from overseas but that's just how it read to me.

    It shouldnt cost anything it was meant to be from London. If I had know it was coming from oversea's I wouldnt have purchased it :(

    So how has it gone through US Customs - just ignore the invoice: any UK duty would have been taken prior to receipt.

    You realise that these type of game cards are illegal? So is this really fine?

    Is this an original DS, or a DS Lite, as DSi or a 3DS? if it's an original DS, then £80 sounds quite a lot to me. You can get a DS from CEX for around £50.

    I think you'll find it hard to persuade the seller to arrange collection at her cost. If you raise a dispute, then send the item back tracked (special delivery or courier), then you will get your original money back once it's been attempted to be delivered and you put the tracking number in the dispute.

    No I had NO idea that it was illegal.. I now sound VERY stupid dont I. I just assumed there was a way to put them all on one memory card....
    The thing for me is that this item was supposed to come from London and be in UK format it has come from Hong KOng and is in American format and I have now recieved an invoice from DHL for 29USD..??
    Totally upset about this I have never had any trouble with ebay before. The seller replied to me last night saying if I paid the invoice she would give me £10.00 compensation....!!! I shouldnt have to pay for an item that the postage was free and it came from the uk :(
    SHe has also asked me to send her a copy of the invoice to her private e-mail but Im not sure if I should do that as it takes me out of the ebay security as such.....
  • If you paid less than 45 days ago simply open a Significantly Not as Described case with eBay. You'll be required to return the DS at your expense. If the returns address is outside the UK message back here for further advice.

    If longer than 45 days how are your Paypal payments funded (Paypal balance, bank account, card)?

    If it says item location is UK, then I would phone eBay and see what they say your best course of action is.

    I cant stand this on eBay myself, if I want to buy from Hong Kong then fair enough, if I want a UK seller then that's what I should get.
  • Also, you are meant to get a warning about import charges on the listing.

    If that's not there, then you should have a good case for INR/SNAD (must admit I'm not sure which one I would open without speaking to eBay first).
