DLA and mobility car

ok 1st time doing this, so here goes.
a member of my family has DLA and and a mobility scheme car.
he has just lost his licence drink driving a one year ban with a reduction if he passes the awareness course he is going to do. ( i know all the wrongs and so does he hard lesson learnt) he is 69 in december
but i need help in knowing what happens to the car ,and the money that is currently paid for this car.
i have found out that is will not be able to get mobility insurance for 5 years and rightly so, but not sure what this means does it mean he keeps the car ? if not will he have to pay for it until the agreements ends or can he hand it back and get the money paid back to him ie the DLA money
so need to know what happens in practical terms to the car and the money currently being paid for this car via his DLA.
the car has 18months left on the 3 year lease.

He will need to ring Motability and discuss it with them, they are the only ones that can help.0

You need to speak to motability. They do have a discretion to allow the contract to be terminated early (I know this because my nephew gave up his car early when he got into financial difficulties and could no longer afford to run it). If motability agree to take back the car, then he gets the mobility component of DLA paid into his bank account in the normal way.I'm a retired employment solicitor. many thanks for the reply, but with it being a DD offence he has breached the terms and conditions so will they make him pay the full term? also is there anyway he can keep the car and insure it himself or is it a package deal

No he can't keep the car and insure it himself, it is a package deal, but in any case with his age and record, insurance would be horrendously expensive.
No-one here can tell you what decision motability will make regarding a request to end the contract early, or on what terms - only motability can tell you that as it is a discretionary decision.
I would think they will be only too pleased to take the car back as it is now presumably uninsured and they will want to protect their asset - but that is just a guess.

This happened to a lady in Glouster, she was convicted of DD while in a motorbility vehicle, the car was taken away from her and she had a year left on it, because she broke the T&Cs of the contract they still kept the money she would have paid for the car but it was reinstated after the year was up, she is not allowed another car for 5 years. Best to ring up and check as it could be different circumstances or somethingnot all on benefits are scroungers and don't need to be bullied!0

thanks for all the advise, when you say it was reinstated, you mean that part of the allowance was paid back to her once year was paid up?
does any know how much the money this part of the DLA is on the higher rate.0 -

wow not a lot to sort your own car and insurance will be a big reality hit for him

£54 a week is not a lot to buy, insure, and maintain a car (hence the motability scheme).
But if he only mainly does local journeys, it might be enough to pay for taxis.
If he needs to do a longer journey he can get a disabled person's rail card
And he is also entitled to a free bus card.
I do realise that this wouldn't give him the flexibility of a car, but it might keep him safer.
Also, sorry for pointing out the obvious, as he is over 65, if he were to lose his HRM DLA he wouldn't get it back as the benefit for over 65's is attendance allowance, and there is no mobility component with that. I am just pointing this out because even people on indefinite awards are occasionally subjected to random checks.I'm a retired employment solicitor.
