Orange contract

Someone who was staying with us took out an orange contract for £40+ pcm for 2 years and then cancelled the direct debit and went back to Spain.
(They are a relative).
Can orange do anything to us?
If they return the phone is it possible that orange would cancel the contract? If they don't pay anything
is it criminal or just a bad debt?

BTW we tried to stop them getting it as they can't afford it.

It's a bad debt only - but I'm surprised they were approved unless they misrepresented who they were. If you become involved, it will be assumed it is you - but you'll have a lot of mail and DCA activity.

The phone has no value to the network as it is S/h. They will not waive the contract.

They can't do anything to you directly, because you are not the one who took out the contract with them.
It is criminal if the person knowingly entered into the contract with the intention of getting the handset and never honouring the contract. It is basically fraud.
However, the likelihood is that Orange will simply pass the account over to debt collectors, who will pursue the outstanding amount plus interest and fees.

You may be indirectly affected in that your address will be associated to a default, in the period you live there.
It may or may not affect your own ability to get credit.

He has a different surname to us but that might not help. We can afford to move for years and we have a good mortgage so hopefully this will not affect us.

My wife was there as a translator so it was all honest.
She was amazed that he got it.

If some financial connection with this person appears in the credit file, it can be removed by adding a notice of disassociation.
