Whiplash / car accident

    If the work cost £650 and the excess on my policy was £200, I would be expected to pay my £200, the insurance company would then have paid the balance but would have ask the other party to pay the total ie £650 and then refund my excess or get it paid directly back to me. As I said I have never claimed on any insurance but this was my understanding and I couldn't pay my excess and then wait to get it back.

    Might be wrong though..............

    i work in insurance claims.

    if your car is a write off then you do not pay the excess - the insurance company give you what the car is worth minus the excess.
    if your car can be repaired then you do pay the excess - to the garage doing the repairs.

    to the OP, go to a solicitor, you can put a claim in for your injury and any other expenses, the solicitor will point you in the right direction.

    even if the driver wasnt named on the policy the insurance company still have a legal duty to reimburse you.

    the police never take much to do with minor car accidents such as this, only when someone is seriously injured do they look into it.

    I was hit from behind by a 4 by 4 I only have a focus i too made a claim those no win no fee, i was off work for 2 weeks had physio for 8 weeks as i couldnt drive i received confirmation last week they offered me £1500. It was worth the wait but it affected loads at work like my sickness bonus and just left me way behind with my cases, it was a major inconvenience.

    OP I would go back to the police and inform them that the other driver has failed to give their insurance details. The police should then be checking for the insurance details to see if an offence has been committed by the other driver ie driving while uninsured.
    Your claim will be against his insurance company, which is why you will need to inform your insurance company of his details.

    A major cause of whiplash injuries is headrest too low. Back of head should nicely rest on centre of headrest. A relative had a whiplash injury as a result of a small rear end shunt and got a trapped nerve as a result - occasional uncontrollable major shoulder spasms for several years till it was fixed using a new type of laser treatment.
  • I don't know if this will help but if you are with a union at work they may sort it all out for you. I know mine does. Also my brother was injured in an accident while travelling in a taxi and his union got him compensation for his injuries. It all took several years but he did get quite a big payout. He had to have physio for a long time.

    I had a very simmilar accident. I was turning right, my bonnet was in the road i was turning in to and a guy hit me - he was driving on the wrong side as was preapring to overtake me even though i was in the middle of crossibng the road! It spun me to face the way i was going and severe whiplash. Althought the doctor i saw that day said mild. I initially put up with the pain hoping it would go. 6 mths later i was in a personal injury claim, saw specialists and much more severe than i had thought. Took 3 years but got a £8k payout. The other party never answered any letters so all went smoothly in my favour. Now over 4 years since accident and i have severe back pain and limited right shoulder movement. pregnancies after accident have helped made my back turn to jelly!
    Make sure you get it looked at properly. If i had at the time i may have avoided all of this. No specialists think i will be back to myself again and im only 23! If only the doctor on the day diagnosed properly and gave me a collar and physio!
