Whiplash / car accident

Had a car accident on Monday when a young lad hit me from behind whilst I was turning - No sure he is on the insuracnce as it was his girlfriends car but police say are unable to tell me anything.

Have been to the doctors and apprently I have classic whiplash - not in too much pain but my neck is stiff and cant raise my right hand too far. As the main carer for my special needs son this is caussing me some pronblems and my Mum is having to take time off from her job to help me out and i'm paying her the same as she would have earnt

The nurse at the Doctors said I should keep a note of any expenses and should be able to claim them back but how can I prove that I've paid my Mum and what else should I look to be keeping ?

The lad wouldn't give me his details but I know that the girl is the daughter of a local police man and was very distredssed when the 1st PC I spoke to basically said put it on your insurance dear and has only taken a full stament when I made a formal complaint.

Am I right in assuming that as he hit me from behind as I was turning its his fault legally?


Any hits or tips on how to deal with this would be appreciated - My car is vital to me and I would really struggle to pay a huge increse in my insurance

    i think you will find please correct me if wrong but if you are hit from behind it is automatically there fault,i had a bump a few years ago now where a motorbike stopped dead in front of me with no warning i luckily only rolled into back of his bike but it was classed as my fault grrrr

    Must say thats what I thought but to be honest feel fobbed off by the police

    it's a bit of a grey area as the police probably don't need to be involved. As you were injured then they need to be informed but otherwise it will all go through your insurance.

    A lorry hit me from behind while I was turning into a road. He was reading a map AND driving!! It is their fault if you are hit from behind. I had whiplash and bruises. The whiplash kicked in the next day and boy was it bad. To this day, I am convinced that the accident is the cause of my constant back pain. :eek: Keep a record of everything. I even got a bill from the hospital but just sent it on to my insurance company who dealt with everything including compensation for lose of earnings, having to hire another car (mine had been written off), etc. Hope you feel better soon.

  • hi there, sorry to hear about the accident...I know how painful it can be.

    if you are worried about proving you are paying your mum, get her work to verify she has been off due to family coimmitments and maybe get her to sign a receipt for the money or better still pay her by bank transfer and keep the slips with her name on.

    keep every little receipt, if u have to go to the hospital and get charged for parking...keep the receipt, i had a weeks worth of frozen food in my boot when i had an accident and they reimbursed me for that too.

    They may well send you an interim payment to help with private physio which will help.

    we had an accident a few years ago, he was an uninsured traveller and gave false name and address, we rang our insurance company and they told us who was insured on that vehicle etc they then persued him as he had given the vehicle to that person, and if he came back and said he hadnt given it the guy had taken it well that was for him to prove etc...so if they girl was insured and she was letting him drive her car uninsured she may have a certain amount of liability too.

    push the police issue to find out and good luck.

    OP, that's awful, I hope you feel better soon.

    I thought you were obliged to give your details at the scene of an accident? and if he isn't insured, then it is a police matter surely?
    You could ask your insurance company for advice as previously suggested - it isn'tyour fault if someone just slams into you and you shouldn't have to take the blame or have it impact on your insurance premiums.

    I was hit from behind and ended up with whiplash a few years ago,
    as i only had tpft insurance i contacted an external company (on a friends recommendation) who provided me with a hire car until the person who went into me insurers paid up for the cost of my own car along with the cost of the hire car. They also put me in touch with a legal executive who claimed more for my whiplash, at no time did i have to pay a penny.

    Worth looking into.

    I am currently going through something similar, I was involved in a no fault accident 8 weeks ago.

    I immediately took my car to my local peugeot dealership, they put me in touch with a company called help hire, I wasn't in a financial position to pay my excess and then wait to get my money back, I was also very concerned about the man who hit me as he was quite aggressive and then weird about giving me his details, I then had several lenghty conversations with his partner who tried repeatedly to talk me out of using any sort of insurance and to get my car fixed on the cheap.

    Through Helphire, I was provided a hire immediately, my car was towed to my delearship, they got in touch with the other party and have sorted out the claim - no excess to pay, no further hassle with the other party, fixed car and my current insurnace company whilst told of the accident were not involved, I have just renewed my insurance and my premium is less than last year.

    My whiplash is still ongoing, still get pain in my neck ( I am sat at my desk all day - which makes in worse ), help hire passed me to a no win no fee firm who have again ( to date ) been great, I have today recieved a medical form from them to get a independent medical review done. My accident was that servere but actual expenses are now at £200 ish and they have suggested that I could claim about £1000 for the pain and discomfort - I am not out to take advantage of the other party but the last 8 weeks have been a pain in the neck ( no pun intended ) and I could have done without the hassle and the ongoing pain so I kind of think some level of compensation is fair.

    My advice would be to get in touch with someone to advise you asap, I have never claimed on any type of insurance ever and the whole thing is new to me but it has been fine, I feel that I have had good advice and proactive people do stuff for me and I haven't had to pay anything, except upfront expenses for physio which I will definitely get back.

    excess £200
    claim amount after adjustment £10,000

    amount paid to you £9,800

    I didn't think you actually had to pay the £200 upfront? I've written off two cars and i'm sure this is the way is worked.

    we have had a few no fault accidents and always had to pay the excess up front, normally to the garage fixing the car when it gets taken in, you then have to claim it back :(
