Barclaycard PPI claim

Hi
Sorry that this question might have been asked before, but i am not able to locate it in the forum
Back-ground:
Got the BC card in July 2003, application made by face to face sale at train station (barclaycard booth). Sales man filled the form, did balance transfer etc with PPI added. I don't remember whether he explained anything to me.
Didn't paid any attention to the account (my fault for not staying on top of finances). I was paying minimum balance every month, BC increased credit limit few times etc until financial difficulties in 2008 due to illness while traveling etc. Financial situation got worst and even after paying minimum charges on the statement, actual balance was going up every month put me outside the credit limit.
Claimed for PPI:
Reason for miss-sale with initial claim: Force full face to face sale, not explained anything.
It got rejected but they told me that they will reconsider if i provide any proof.
After searching through my records including my credit report, realized that I was unemployed when PPI was sold to me i.e. finished the running contract in june 2003, PPI/CC started in July 2003 and next weekly job contract started on Sep 2003.
I have replied to the letter with charges and proof by proving the letter from the employer confirming the contract duration.
It has been more than six week since i replied to them but they are yet to respond. To save time, i have forwarded all the documents to fos for their consideration.
Please let me know your opinion on the chances to get the PPI back from this account.
Thanks
P.S: I am also claiming for unfair charges on the account due to the fact that they were keep changing the cc limit and due to their charges and PPI i got over the recent credit limit is acquiring £12 charge every month

Hi and welcome
Have the not sent you a confirmation letter since you asked them to review with the enclosed further information you provided?
I would contact them direct.
Even though they have 8 weeks, this I assume with the further information you provided has well achieved those timescales by now.
Or contact the CEO (Chief executive officer) of the business, although the CEO will not respond direct - but should pass on your details on to the complaints dept team.
The fact that you were unemployed, is at least a reason for you to make a reclaim on the PPI, at least.
It's possibly they will oveturn the decision in your favour.
Good luck. The one and only "Dizzy Di"

Now that you've effectively referred your case to FOS, the Bank will cease all correspondence on the issue with you. The Ombudsman process is currently taking in excess of a year.milan.1680 wrote: »It has been more than six week since i replied to them but they are yet to respond. You'll need to fulfil very specific "hardship" criteria in order to qualify for any refund of charges. The Bank are under no compulsion to refund and anything you may get will be classed as a "goodwill" payment.milan.1680 wrote: »I am also claiming for unfair charges on the account due to the fact that they were keep changing the cc limit and due to their charges and PPI i got over the recent credit limit is acquiring £12 charge every month0 -

Hi Guys...
thanks for the super quick responses.
I have not received any conformation from them. I did send them another letter on 29/10/2012 requesting them to responds to my letter, so, hopefully i hear anything back from them.
Only reason i send it to FOS is to get my file in the queue (did had a conformation email from them with the case reference number) and hoping that barclaycard will still review the additional documents and make decision on it.
I will have to wait and watch, I guess.
What do you guys think about the chances of PPI claim being upheld by FOS or BC?
Thanks0 -
As I've already stated, now that you've referred your complaint to FOS (with a confirmed case reference number) you can forget about receiving any more correspondence from the Bank about it.milan.1680 wrote: »Only reason i send it to FOS is to get my file in the queue (did had a conformation email from them with the case reference number) and hoping that barclaycard will still review the additional documents and make decision on it.
Do let us know how you get on at FOS....0 -
Was this not covered by the PPI policy?milan.1680 wrote: »until financial difficulties in 2008 due to illness while traveling0 -
Loss of income due to illness was covered. Employer did stopped my normal salary and put me on statutory sick pay. I raised the point during my PPI claim as well that they did hold up on the agreement from their side as they did upheld the claim or never did they responded to claim.
Their exclusion criterion was applied to me from day 1 as I was unemployed when policy started. I have provided the proof of this to both BC and FOS. I am hoping that this is a strong enough ground with face to face force full sale to get it upheld in my favour!0 -
You say that loss of income due to illness was covered so why didn't you claim on the PPI policy then? Or is that sentence as mixed up as the rest of your post? You need to explain this better as its not making a lot of sense the way you have written it!milan.1680 wrote: »Loss of income due to illness was covered. Hi...
Finally I have received a letter from FOS stating Barclays are going to make me an offer, as a goodwill gesture and not admitting the mistake.
They will calculate refund as per the FOS guidelines.
I was wondering, how much would I get back? So, far I have paid over £2000 just on PPI. (current balance £5200, card taken out in 2003 and PPI was added from day one).
Waiting for a letter from Barclaycard...!!! Hopefully it will be respectful
