Holiday paid on CC, Hospital means i can't go

Hi, Hoping for some advice since Barclaycard website is less than forthcoming.

I paid for a small holiday (£150) with Hoseasons on my credit card. Alas i had to be rushed into hospital and we could not go, i phoned the Hoseasons and they stated it was a 100% loss.

My question is can i claim anything back from the credit card?

My Doctor has told me she is happy to provide proof as is the hospital. So i have that angle covered.

I tried the website for BC but i cannot find anything, although its very useful for providing details on new cards (with HUGE apr % rates)...:rotfl:

    No because Hoseasons did nothing wrong and are not liable for what happened (hence the CC comany are not liable either).

    Did you take any travel insurance? Travel insurance would cover you for cancellation due to medical emergency/
    If your credit card comes with some travel insurance benefits then you may be covered under that, but that would be a benefit offered by the card and not a statutory right.
    If you can't find it on the website then look in your paperwork, call the company or send them an email, but I'm afraid if it's not on the website the indication is that's it's not an offered benefit. Still worth an email or phone call for £150 I'd say.
  • Hoseasons didn't fail to provide the holiday so it isn't a Section 75 claim. Unless Barclaycard offer travel insurance as a perk to the card then no. Ask Hoseasons if they'll defer the booking or offer money off a future booking as a goodwill gesture.

  • By the way even if you have travel insurance it often won't cover UK holidays but it's still worth a call to find out.

    No chargeback right, as the holiday was avaiable.

    No section 75 cover as it was you who breeched the contract.

    Did you not take out the ins cover that the retailer offers? In case you cant make it.

    Might be worth while asking if Hoseasons are prepared to offer something as good will.

    Do you have travel insurance as part of a fee paying current account? Certain Nationwide or Co-op accounts may do it for free.

    If not, you're going nowhere here.

    Worth double checking the Hoseasons booking conditions to make sure that this is correct. (Probably is.)
  • sorry to hear you were unwell and missed out on your holiday :( not much to add, other than whether you had taken out travel insurance? also when did you call to say you weren't coming? I used to work in a hotel and for prepaid booking (non refundable) we would have made an exception in a case like this, best of luck.

    Credit Card would not be liable as no one has defaulted on the product/service you bought. Did you buy travel insurance that covers cancellation? This is where you would be able to reclaim costs.

    I have just had to stand the loss from a holiday cottage booked for a weekend for three elderly relatives that were attending a wedding. One of the relatives was rushed to hospital and is now recovering but due to the long journey (over seven hours) and two hectic days followed by the return journey they feel they are not up to the travel.
    Medically they would be told they were okay to travel but they themselves feel unable to make the journey. The cottage (at this late stage) would give 10% refund at the very most and only if a doctors note says too ill to travel.

    We knew this at the time of booking (months ago) and made the choice not to insure for cancellation and have just taken the loss on the chin, as only one relative will now be coming and they will stay with us.

    If you have been told by Hoseasons it is 100% loss (as many companies do - Expedia are the same) and have no cancellation insurance you will have no comeback.
