HalifaxPhone call help!!
Hello I will keep this short and to the point, I recently called Halifax bank to see if we had any PPI on two loans we had takenout in 2006 and paid. It turns out we did and we were then transferred to a PPI claim back department in Halifax bank. I was then asked on the telephone how i felt I was miss sold PPI? I then replayed with..
I then received a letter to say they are now gathering information and documentation relevant to your complaint to help them assess the claim further. With some financial ombudsman info and leaflet ect.. Just the normal response..
About a week goes by and I receive another phone call from Halifax asking if I recall anything about the conversation that I had the day I took the PPI out?? .. I didn’tknow what to say so I told them '' Im super busy at the moment, Sorry but if at all possible could they correspond in writing.
I had no idea what to tell them.....
Does anyone know what I should do next? or what I should say to them when asked this question again?
ManyThanks

- I felt pressured into taking the policy
- I was not advised that the insurance was optional
- I did not give explicit consent to taking out the policy

You should tell them the truth.
Be aware though, that your complaint [no matter how true it is] is hearsay, and you can't prove this.
You might be lucky and they'll identify another failing, or they may py out because you're under the payout threshold. Now you'll just have to wait.Non me fac calcitrare tuum culi0 -

If this is the case, how can you be so sure of what you have listed in the bullet points.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -

The important thing to remember is to be truthful if they ring you with regard to your complaint. If you do this there is less likelihood of any contradictions in your testimony. If you don't know or remember details, then don't attempt to give them.0 -
As taff says, your first 2 points are your word against theirs so won't hold much weight. As for the last point, the fact that you signed the loan application was your consent to taking out the policy as it would have been there in writing for you to read and check before signing.
What about all the other people that sign there loan applications and reclaimed PPI? How does that make my case diffrent from any other?0 -

Thanks for the advise. I took the reasons direct from the Money Saving Expert site.. LOL
Were you told it was compulsory?
It's a common complaint that consumers are told they must buy a policy from the same provider as the loan in order to be accepted for the product. This is mis-selling.
Any company that subscribes to the Lending Code agrees it won't insist you buy an insurance product from it. Therefore if the salesperson:- Didn't make it clear the policy was optional or tell you about any cooling off period
- Implied or stated it would be more expensive if you didn't take the insurance
- Implied or insisted you take out their policy to qualify for the product or help with your application
- Was very pushy when selling the product, so that you felt you could not say no
- Would not let you continue with the application if you did not sign the insurance agreement as well

you get a payment if a claim is upheld, whether that's because your complaint is upheld for a verifiable reason i.e. there is paperwork or phone call evidence that it was missold for a variety of reasons, or you are under the payout threshold for that particular company.
Saying that you felt pressured into having is not a verifiable reason unless there is a recording fot hat conversation, so your compaint is hearsay and not provable.Non me fac calcitrare tuum culi0 -
