    How is it ignorant and misleading, any tickets issued after 01/10/2012 are on the vehicles owner unless they can prove someone else was driving, read it.

    Therefore they can take you to court and force you to pay.

    Unless you have proof to the contrary to back up your statement, as mine was based on reading the new law quoted!

    As I said - IGNORANCE! and willful misleading ignorance at that.

    The fundamentals have not changed one bit and PPCs still cannot pursue you for illegal contract penalties.

    Plenty of discussion and explanation over on the parking board if you want to educate yourself.

    Yes, yes, we can all just repeat ourselves, but again like I said, post the proof, don't just point me to a board.

    Per my post on the 26th - Assuming private as in McDonalds / Hospitals / Asda Etc

    If your ticket was issued before ~or~ after the new law, also, ignore it

    Write back once only and say "do not send any more threatening letters as it is criminal offence - I wish to have my day in court"

    If they send round debt collectors don't open the door - tell them "you are demanding money with menaces and are trespassing, leave now or I will ring the police and have you arrested.

    If the debt collectors don't leave immediately, ask them to put one of their cards through the door, when you have their details ring the police, when the police arrive tell them they are both (1) 'demanding money with menaces and (2) trespassing and you want them to leave now'

    Note : No one, not one single person on this Island has ever been successfully prosecuted.

    Be aware that parking companies have employees on forums and they will obviously want people to think they have to pay.

    Some will even pm posters with a load of crap from a 'concerned' fellow poster.

    You don't need to pay a private parking charge from before or after October.

    You can still completely ignore it.

    The point I was making is now they can take the registered keeper to court easier for non payment. I wasn't aware you could still ignore and based it on my opinion I answered.

    It was not an ignorant answer, possibly misleading but as no case law exist yet for the changes, who knows. Only time will tell.

    @richie, better way of stating how to deal with them then pogo and better explained, thank you. Saved trawling through umpteen posts to ascertain the 'law'.

    NO it isnt any easier for them to take you to court. Its still the same, no difference. In fact if they dont own the land then they have no rights taking anyone to court, only the landowner can do that as per a recent court case. Its simply based on Contract Law.
    The procedure (as per the definitive website on the subject, Pepipoo) is. You get a ticket by a PPC, you appeal it, Thats a great idea as it costs you nothing and costs them £27. Then even if you lose the appeal you simply dont pay as the PPC has no legal right to punish anyone on grounds it does not own, only the landowner can do that under Contract Law..
    The other thing worth mentioning is any PPC could only rightly claim for their losses, anything above that is considered punitive so if you get a ticket by a PPC in a Free carpark for overstaying their losses would be £0. That why they never go to court.

    The law is based on VCS v HM Revenue & Customs. Where it was clearly stated by the Judges that only a Landowner has rights under Contract law and PPC's cannot take legal action
