The new legislation requires them to affix their "invoice" to a stationary vehicle at the time of the supposed transgression for it to even have a very very very slim chance of being enforceable. Clearly that did not happen so they are just pi55ing in the wind sending anything to you. Ignore.

No it doesn't. ANPR camera-generated fake PCNs are also in the legislation - it was added in during the reading of the Bill otherwise Parking Eye and co would have thrown their toys out of the pram. Pressure was applied by the BPA (as appears to have been the case throughout the whole process).

Agreed they are just pi55ing in the wind though!

That was in the first draft, however BPA lobbying got ANPR added!

Maybe the BPA told em some porkies along the way, like the 36000 people they pursue each year through the courts!

even with the new law from 1st oct. they still can't do anything?
All the legislation allows is for the PPC to hold the vehicle's registered keeper liable if you (the RK) don't tell them who the driver was (never mind if it's the same person). It changes nothing around the (il)legitimacy of the tickets themselves.

it doesn't really say why it was issued just says......''by either not purchasing the appropriate parking time or by remaining at the car park for longer than permitted''..........
surely they should know why theyare issuing the charge?

However, from this information you have given, they cannot even do that, as they have failed to meet their own obligations under the legislation.
  • if memory serves theres no parking eye signs at caunce st entrance to this car park (which has a car wash in it), all more reason to tell them to go & take running jump
  • thanks everyone much appreciated

i have the letter here with me with two photo's on it of my car entering the car park at 851am and leaving at 2331.since the law changed on the 1st october do i have to pay the charge?
Also why is it a charge and not a fine?

    thanks mickthemod
    Hi Mick,

Went to blackpool last week end for a few days and parked in what I believed to be a pay and display car park
The car park was not lite and very dark and did not see any signage saying it was a privet car park and paid at a pay and display machine at the top border of the car park.
On arrival home had a letter from parking eye asking for £100 or £60 paid in 14 days
I was in this car park for 20min
This as really stressed me out as I have only my 14yr old daughter to confirm that I paid at the machine.

If it was the same car park, then having read this thread, you'll know what to do.

P.S. You should scrub your email address from your post - not a good idea.

What?! You don't need to be stressed and your daughter doesn;t have to confirm anything, any more than you do!

Like all the other posters on this board, you have a fake PCN.

As long as it's not a company/hire/lease car then you can just ignore it and ignore the other letters that will arrive. As you were sent the fake PCN in the post (I assume?) then obviously the registered keeper is you which makes it easy to ignore.

The letters are easy to predict and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

    Don't be victims! :)

There is no fine, no CCJ, no bailiff, no debt, no effect on credit rating, no Court, no repercussions at all.

Tick off the threatening letters here.

Watchdog clip with expert Solicitor's opinion, using a fake PCN with nice photos of a car (probs very much like your fake PCN!) here.

Barrister's opinion - read the answer at the bottom, it's very clear! - here.

So simply choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority. Just play snap with each letter against the first link, then the scam fizzles out - simple!
