Hi
When I was with my ex girlfriend I paid her insurance on my car and when we split up so wouldn't give me it back. She has now wrote it off ! As I'm the registered keeper does the insurance pay out come to me or to her as I know i'll not get any money off her. At the moment she will not tell me anything that is happening so was just asking if anybody has any help or advice.
Thanks Paul

Sorry but if you are the registered keeper, and she wouldn't give it back when you split up; she technically stole it.
Surely you should have reported her to the police.
Why are you still paying HER insurance ?0 -
Policy holder would normally be paid out but it could get complicated because some of policies insist that the policy holder is also the registered keeper. Was your ex just a named driver?Be Alert..........Britain needs lerts.0

If you know the company she is with, write/phone them although they wont tell you anything advise them that you are the registered legal owner also without the v5 they dont like so much to pay out as quick.Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

I payed the insurance off in one hit out of my bank account and they have a copy of the V5 so should see that I'm the registered keeper.0 -
Unless there is finance secured against the vehicle then the payment is made to the policyholder.
The fact you are the legal owner of the vehicle is between you and her. She is the one with a contract stating she is entitled to have damages to the stated vehicle reimbursed.
Of cause you could try and give them a tip off that it isnt her vehicle and thus there may be indemnity issues if she hasnt correctly declared who the owner of the vehicle is but then you may be biting off your nose to spite your face as it simply means no one gets paid0 -

Not necesserily true.
If you look at a registration document it says in big red letters "the keeper is not necessarily the legal owner" or similar.
Just because the OP is the keeper does not mean he's the legal owner.
If there is a dispute, it's up to the courts to decide who the owner is depending on who negotiated the sale, whose name is on the receipt/sale agreement, who visited the dealer to pay, whose bank account was it paid from, etc.
Having your name on the V5 is good supporting evidence for ownership but not conclusive.
The insurer should pay out to the legal owner and would request the V5 as a matter of routine, in order to register themselves (or the scrappy) as the new keeper.
If the keeper claimed to be the owner (which is true in most cases) they probably wouldn't ask any more questions, but in this case, I think they would ask why the policyholder isn't the keeper.
When the policy was taken out did the GF state that someone else was the owner and / or keeper? If not, she's failed to declare a material fact and they probably won't pay out anyway.
If she did, then they should be investigating who deserves the payout.
If the OP believes that he's the legal owner, he should write to the insurer and ask them to pay HIM (as keeper and owner). The insurers' details can be obtained from askmid.com
If he reports it stolen, there is a risk that the GF's insurers won't pay out, because insurance will never cover you to drive a stolen or TWOC'd car belonging to someone else, even if you've bought a policy on the car in your own name.We need the earth for food, water, and shelter.
The earth needs us for nothing.
The earth does not belong to us.

the car payments were payed from my bank and payed the car off in full last year the car was bought in my name and I'm a named driver on the insurance. The reason it was insured in her name was that I have a work van and as she had full no claims it made sense to insure it in her name as I never used it much ( groan how wrong now).I went on mid and car has come up showing its insured but how do I find out who the insurer is so I can ring them?
Thanks for all your help so far.0 -
