Rbs sar letter

New to the forum so please bear with me! Site has given me confidence to finally do something about mis-sold PPI ... without resorting to a claims company. But I will no doubt need lots of help and encouragement!:)

Wrote initial letter using template on site and enclosing £1 cheque to RBS credit card centre quoting two card numbers (Mastercard that then changed to RBS Advanta card) and asking for copy of T&C. Received reply today saying that, as account no longer active, they are under no obligation to provide me with requested documentation - charming!

As I no longer have original documentation (got the card numbers from old receipts - when they quoted the whole number!), it looks like I will need to send a SAR letter & £10 cheque - but do I send it to the RBS credit card centre in Southend On Sea quoting the card numbers or should I send it to the registered office in Edinburgh?

I have also sent an initial letter & £1 cheque to the registered office concerning a RBS personal loan although I haven't received a reply yet.

Should I infact just send a SAR letter quoting my RBS current account number - would this generate information on both my credit cards and my loan in one easy (!) step?

Might it even provide information on other loans/cards (Abbey National, Yorkshire Building Society, M&S Bank) as all have been paid into or out of this current account over the years? It might not give me much information on other companies but could it at least provide reference numbers to quote when sending SAR letters to the individual companies?

My head is spinning with it all - so any advice would be much appreciated! :o I am hoping that once I have dealt with RBS I will know what to do with all the rest!

    Their response is correct. Nothing to do with charm. If you are going to quote section 78 of the CCA to them when it doesnt apply then you should expect a rejection like that.

    If the debt is still outstanding then S78 does apply. If it is not then you will likely get the same response.

    Remember that you do not need the agreements to make a complaint. Agreements will also not aid you in your complaint either. What is it that you are looking to achieve with the agreements?

    I know that when I took out my credit cards, I completed a form from my local branch and handed it back into them. I was told at the time that, as I had no credit history, it was unlikely that I would get the credit card without taking out PPI ..... so I reluctantly agreed. But I did not sign or tick any box on the form - so would like to see copy of agreement to see if person in branch wrote anything on it to that effect. As for loan, I am not aware of having PPI on it, but given instances of others unknowingly paying it, would like to see agreement to check. If so, then I would like to claim PPI back, but don't have loan agreement so can't quote reference number.

    Is there any way you can try tracking down the loan account on statements where you paid the loan monthly payments by direct debit?

    The point is that it clearly states in the instructions on this site that Terms and Conditions are not available for closed accounts. You went ahead and requested them anyway and were then describing their not surprisingly curt response as "charming"!
    I understand that you are starting to learn, but you need to read the complaint steps carefully as you will only get one chance to put your case to the Bank.

    You can send a Subject Access Request (SAR) letter, but it will only guarantee to provide you with all records the Bank has kept for the past six years. It's possible you could receive older material (especially if you are still a customer of that Bank), so it's up to you whether you want to gamble the £10 cost.

    To be honest, your (potential) complaint reasons are very weak hearsay, especially considering you are not even sure you had PPI on the loan.

    Most but not all destroy records after 6 years. You need to decide if £10 per provider is worth it to find out if you had. However, having it is just the first stage. There needs to be an identified failing....

    If that happened then it is wrong but you can bet your life they have nothing to support that allegation and you almost certainly do not. Verbal unprovable allegations rarely succeed without another identifiable failure existing or getting lucky under auto payout.

    In many cases the application is not the agreement. More likely not to be with loans than credit cards.

  • I did not read the comments and then ignore them .... I simply did not interpret closed account as refering to my credit card - I thought as long as my account with the RBS was current (which it is) then they would still have details. Unfortunately, although I still have all my bank statements, they do not give the reference number for the loan.

    I am beginning to think that I should just forget it .... or leave it to a claims company after all! But I thank Dunstonh and di3004 for trying to help in a positive way rather than simply pointing out my failings.:(

    A claims company does no more than put a stamp on the envelope of the form you have filled in and sends it to the same place you would.

  • Yes, I know, that is why I was going to try to do it myself .... and reading some of the postings on this site had finally given me the confidence to do so. But not having done so before, it is difficult to know the best way to do it ... hence asking for advice from those that have been there and done it already!:)

    Perhaps I should have simply stated the overall situation and asked for advice without getting into specifics ..... so here goes. I have had a number of cards/loans that are all more than 6 years old and for which I have no documentation (I did until a few years ago when I shredded the lot!):mad: - but I do have bank statements that show when and for how much loans were taken out/paid off payments made. Unfortunately, there are no reference numbers given on my statements. So situation as it stands is as follows:

    RBS Credit Cards - Know both card numbers from old receipts (one changed into the other) and know PPI taken out - strongly believe it was mis-sold.
    RBS Loan - No reference numbers - unsure if PPI insurance on loan.
    Abbey Loan - No reference numbers - unsure if PPI insurance on loan.
    M&S Loan - No reference numbers - unsure if PPI insurance on loan.
    M&S Chargecard - No reference numbers - suspect PPI insurance may be on card.
    Yorkshire Building Society - No reference number but know PPI taken out - believe it was mis-sold.

    I obviously don't want to raise a claim for loans unless I know that I had PPI insurance on them (without my knowledge obviously :)!) .

    I naturally want to have as much information as possible before deciding if I will be making a claim, but am uncertain know if there is any point in sending a SAR letter to any of them if more than 6 years ago.

    At the moment, I am thinking of just sending a SAR letter to RBS on the basis that I have been their customer since my university days (more than 20 years) so they may have information going further back.

    Otherwise, without reference numbers or documentation, I don't see any point in pursing anyone else.

    But any suggestions you can make would be appreciated.:):):)
  • ToffeePoppetFan - I have had similar letter back about our loan saying that account was closed ; what I've done, was ringing RBS PPI dedicated phone help line - they advised me to send a letter requesting any information about data they hold (without quoting any paragraphs) attaching copy of my ID (to send it to manchester office), which I did, mentioning this was following my phone conversation with one of their staff, no means of payments included. I have received copies of basic information in regards to closed loans (account/sort code numbers and PPI premium amount, if that was included), recent statements and also some additional information about data they keep on me and my husband.
