Notice of Intended

At work, I've just received a notice of intended prosecution from the police for a speeding offence.

The offence took place on a stretch of road that the vehicle passes on frequently thoughout the day. As there are several people, I think 3, that drove the truck on that day, I need to give the correct driver details. My boss and owner of the truck is adamant it's not him, as he was aware of the speed check in progress.

I asked for the photographic evidence, but it only shows the rear of the vehicle, and not the driver. It was a mobile speed check vehicle.

How do I proceed, as the form doesn't allow for unknown person.

    Ask on Pepipoo is probably the best way forward. They tend to know their stuff their (have a read of some threads before posting too).

    If I mind correctly though, not knowing who was driving isn't a good defence as the company must keep accurate logs of who was in what vehicle when. Sure someone will correct me if that is wrong.

    When you say "truck" - is it fitted with a tacho? If so the tacho records will show you who was driving it at the time of the offence. (If the records are accurately kept)

    With a digitacho it will as each driver has his own card.

    As has already been said it is an offence for the firm not to keep accurate records. Ideally each driver should sign the vehicle out and in with a date and time. I dont know the penalty but it could be the same as for speeding to stop people 'forgetting' who was driving.

    I thought not having the tacho records was a worse offence.
  • It's a small tipper truck, only carried about 1 ton, and there's not a tacho in it.

    It highlights the boss should keep a record of who drives it and when. Until recently it was just driven by the registered keeper, but due to a project, others have been helping and delivering, with the boss only thinking about the insurance aspect.

    If the boss cant confirm whoi was driving looks like he will have to take the can for 1 of 2 offences (speeding or no records).

    Thought the no records thing was right.

    As said before - get on www.Pepipoo.com and ask there. If it was you, lets be fair most people would if it was or not if they have the time of the incident, they are probably in the best place to help.

    I presume your boss has already submitted a S172 form naming you as the driver, which is why you have now been sent a letter. Perhaps you should ask him why he knows it was you, perhaps he may be able to jog your memory.

    If you honestly can't recall who was driving despite your best efforts, then you need to let the camera partnership know.
    Make everything as simple as possible, but not simpler.

    If you got it then it looks like he fingered you. How else would they get your details?
    Owner and keeper = the boss but NIP is in your name?

    You can deny it and show that he has no procedure in place for recording who drives the vehicle.

    He will probably have issues for failing to have a procedure in place and the ticket itself.
