  • This case has now been passed to Debt Recovery Plus Ltd who I suspect from reading various threads is an aligned or fully owned part of the parking company in question.

    They have confirmed that it would be a NPO they would pursue us under, am I correct in my understanding that they could attempt this at their considerable cost and I should therefore consdier their letters as hollow threats?

    Any suggestions or pointers gratefully received.

    Just ignore them, debt recovery + are just toothless wonders

    Haddylass, as teh experts on here say, play 'letter bingo' and continue to ignore.
    this is nothing more than a scam where they send you unenforcable invoices and expect you to pay - its hearly up there with teh priminister of nigeria offering to put money in your account of you send him your bank details :)

    A NPO order can only ask you to disclose what you know.
    If you Know nothing, then that is the answer, there is no penalty for not knowing the answer that the people asking the question want.
    In other words, it is an expensive waste of time order, hence an empty threat.

    Good on you for smarting up here, they are no end of crooks who will try to take your money.
    These are one of them.
    Treat it no differently as you would treat any invoice sent to you for something you have not ordered.
    And in the minuscule chance of a NPO, just fill it in "Dont Know".
    They can not drag other Legislative acts over with regards to keeping records as they are not a prosecuting authority, just a two bit parking firm with a accountants mail box fake front.

    An NPO costs hundreds and they must pay for this themselves, they hardly going to do that for a claim of about a £100 are they? Also this is not normally used in the small claims track. And they have never done this before

  • Personal information requests for Xxxxxxxx Xxxxxxxx Ltd employees



    At certain times requests are made of Xxxxxxxx Xxxxxxxx to provide employee information from records held within the Company.



    Following advice from the Information Commissioners Office in relation to the Data Protection Act please see the following procedures for information requests for Xxxxxxxx Xxxxxxxx employees.


    1)
    Personal data will not be disclosed to a third party without the consent of the employee, unless the disclosure is permitted by law under statute or is necessary for the prevention or detection of crime or following an order from a court.


    2)
    Xxxxxxxx Xxxxxxxx Ltd are obliged to provide information to the Police, Child Support Agency, Tax Office and Department of Social Security without gaining employee consent to release information.


    3)
    Information to banks/building societies or any other requests either from companies or individuals will only be released with written consent from the employee.


    4)
    Telephone enquiries for personal information from institutions or companies will be refused.


    5)
    Written requests for information should be supported by written consent from the employee and be on official headed company paper as proof of legitimacy.


    6)
    Personal information will only be divulged with the written consent of the employee unless we are obliged to provide the information to organisations as detailed above and therefore the company and or organisation making the request must provide that written consent.


    7)
    Therefore unless the company and or organisation making such a request are able to provide us with either the written consent of the individual to release the information or a copy of your Company's Statutory right to receive the information without consent we are unable to provide any information regarding our employees.
  • Wasn't sure how the above would come out after copying from Excel but that is what we would send to any company requesting information about one of our employees.

    We sent it to Roxburghe and threatened them with the police and OFT if they persisted.

    They messed their pants and ran a mile.

    I'm not sure how that will pan out under pofa 2012 , but as long as the RK is happy to receive threatograms there's not a lot the scammers can do. Though if its a leasing company that has provided details of the hirer then the parking company cannot go back to them as they have provided a serviceable address.

    But my company has done something similar, I refused them permission to release my details to them citing the dpa on this, though the fleet manager knows this is a scam anyway.
