Tax Credit - Not updating address change for a long time

Hi,

My friend came to UK on student visa(2007 May) and started working part time for few months and stopped working and fully concentrated on studies. He did receive a P45 when he left the place. (Early 2008) But during this time he has changed his residency but he never updated his address details.

Now after few years he is on Spouse visa and started working full time and paying NI and other taxes.
When he joined the new place(early 2012) he has given his new address when filling P45(not sure) and mentioned this is his FIRST job as for the past few years he was not working)

1) Few days back he phoned HRM to find about Working Tax Credit for himself(Spouse Visa) and his Partner(Permanent Resident of UK). He wanted to find out if he is too eligible for Tax credit since his visa says No Recourse to Public Funds).

They said they cannot verify his identity and asked him to bring 2 proof of identity(Passport and Bank Statement) for an interview.

******* QUESTION: WILL HE GET INTO TROUBLE BECAUSE HE HAS NOT UPDATED HIS DETAILS? HE JUST WANTED TO MAKE SURE HIS PARTNER GETS THE CREDIT AND NOT INTERESTED IN GETTING BACK "SOMETHING" FOR HIMSELF.

    He has no entitlement to any tax credits, as for getting into trouble for not updating his details i would only imagine this would happen if that is stipulated on his agreement with the home office when he was issued his visa.

    One question, what do you mean by "stipulated on his agreement with the home office when he was issued his visa".

    Do you mean Inland revenue will contact home office? Any ways he has nothing to worry because when appling for partner visa he did give all the correct info. Even details about his part time work done, educational letters and all related documents.

    What do you think about this paragraph mentioned in the HM revenue and customs web site.

    "You're subject to immigration control - when can you get tax credits?
    -You have a partner (My friends partner has ILR )

    You can get tax credits if you have a partner in the UK who:
    isn't subject to immigration control

    is subject to immigration control, but whose circumstances are covered by any of the sections below
    You will still need to meet the normal qualifying rules, such as the hours worked and your income. "

    Tax Credits you seem to of found information on the correct sites.

    With regards to 'stipulation'...When applying for a visa the Homeoffice/UK Border Agency will have issued paperwork, what does this say with regards to rules/regulations on the agreement of issuing a Visa?
    It maybe states that the applicant has to keep them informed of movements ie: employment and house moves...or it may not, your friend needs to read his paperwork.

    Well whenever he renew his visa he has given correct address details. (Has provided tenancy agreements, Electrol register confirmations etc..) He always received correspondence with the home office.

  • I don't know much about the visa, but I had to go to an interview with HMRC to prove who I am, even though I am a perm resident of the UK because their system didn't match the address I was currently at. A quick check of my proof and that was it.

    I was asked to bring the Passport and Bank Statement. How about you? Is it a lengthy process. Is it just they update their system.

  • I took my provisional licence and council tax bill because I don't get paper statements from my bank. They checked the photo, asked new address details, and pretty much updated it and sent me away within 10 minutes.

    Thanks. Have you previously filled any tax forms(they usually send to the address every year isnt it).

    So far he has not filled any forms as we believe even if they had sent some forms might have been posted to his old address(the address given four years back)

    With 'no recourse to public funds' on your visa, then quite simply, no, you are not entitled to any form of help in form of benefits of any kind, other than child benefit if you were eligible for that.

    Your spouse who is a permanent resident is eligible to claim, and they MUST include you as a co-applicant (if you are in fact living together) - as your income is taken into account for anything meanstested, there just won't be anything extra payable on behalf of you.

    When you apply for your ILR, checks may be done, they may ask for bank statements etc., so you don't want anything untoward showing up.
