Ombudsman Rejects PPI CLaim self employed argument

I have taken HSBC to the ombudsman for mis selling ppi as was self employed. The ombudsman has written to me saying he is minded to reject my claim because he doesn't consider the HSBC terms as onerous.

He has quoted them as follows:-

If you are self employed, to make an unemployment claim you will need to provide evidence that:

-you stopped work because you could not find enough work to meet all your reasonable business and living expenses and declared this to the inland revenue, and

-the unemployment is not normal or seasonal in your line of work.


Any assistance would be greatly appreciated

    You'd probably get a lot more assistance over your question of reclaiming PPI over on the Reclaim PPI & Other Insurance board ;)

    Contact the board guide and ask for your thread to be moved there :)

    Seeing as most PPI does cover the self employed, that complaint reason is usually not good enough unless the terms are onerous.

    Typically, if the PPI covers self employed and has conditions no more onerous than you need to cease paying class 2 NI and sign on then you would expect to be rejected. As HSBC appears to only require that then there doesnt seem to be a problem here.

    So, why are you complaining?

    Answered on your other thread;

    You've lost, mate, the Ombudsman is the final arbiter. Being self-employed is only a valid complaint reason if the PPI policy didn't cover you at all or the terms were so onerous as to almost make it impossible to claim.

    While some lenders (and early PPI policies) did indeed exclude the self-employed, your particular loan or credit card insurance clearly did cover you.
