need some help reg what im entitled to

hi, my partner and I were originally claiming as a couple on benefits, i was on incapacity benefit and he was on job seekers allowance
he found a job and is now on minimum wage.
they say im not entitled to any benefits, so we have to get by on our own with our 10yr old daughter, im not in a position to go back to work at present due to health reasons.
is anyone else in this situation?
am i being fobbed off? am i entitled to money?
im still getting my housing benefit atm which helps as obviously we couldnt afford to pay full rent. but i registered with a routes to work program, they said they could help me when im able to go back to work, but i could only get the grants if i was on benefit...... the government go on about all these people and statistics about employment
but i bet they forget the amount of people in my situation....we might not be on the system but we are not employed, and not entitled to anything

sorry to go on and on but this sickens me... i know of several people who are getting away with benefit fraud and we try to do things right and get punished
this just isnt fair at all

    I don't mean to be awkward but you ARE receiving benefits if you're getting HB. Are you saying that this is going to stop? Aren't you better off on minimum wage than claiming JSA? Sorry if I've misunderstood something.
  • Why can you not continue to get Incapacity Benefit? The only income that affects it is if you have an an Occupational Pension. Other income or savings don't come into it.

  • I went for my medical in may, in november they said i was no longer entitiled to it, seems i was getting jobseekers allowance although i was handing in sicklines all along, as for my housing benefit its up for renewal and im scared incase i get taken off it, i tried https://www.entitledto.com and it say im entitled to some not all, yet my circumstances havent changed

    I'm still confused; surely your husband's job (even on minimum wage) is more than JSA for a couple ? Could you look at part time work?
  • I don't understand why you were getting Jobseekers Allowance if you were handing in sick lines.

    Am I correct in thinking that you were on Incapacity Benefit, then failed a medical so it was stopped (and so did the sick lines), then your husband claimed JSA for both of you and now he has got a job? Is that what has happened?

    If this is what has happened then you won't be able to claim any benefits for yourself; he is supposed to support you from his wages.

    You may as a family be entitled to some Council Tax Benefit and Housing Benefit, and maybe some Tax Credits although I don't know a lot about those.

    Please clarify your circumstances and then we can give accurate advice.

    If you have some health issues (depression, physical problems, etc...) then what to do, is talk to your GP about them, and then talk to the DSS about your claim. Inform them that your GP has gave you a letter, telling you that you cant work, and they should give you something.

    The problem with 1 partner working and one not, is that the working partner could be earning loads.
    Never do things tomorow when you can do them today.

    You should definitely be getting tax credits - child tax credits at the very least, but probably working tax credits too!

    If you are unable to work, and your doctor agrees with this, then I suggest you visit your local CAB and ask them to look into it for you. They are very good in situations like this and will help you get any benefits you are entitled to.

    But at the very least - get a tax credit claim in asap as you WILL be entitled if your OH is on the minimum wage and you have a 10 yr old child. They will only backdate so far though, so don't hang around, even if you have to put a claim in without supporting evidence to start with - just to get you on the system.

  • i was on incapacity yes, and they changed it to him claiming for us both on jsa, but i did still get sicklines from the docs and handed them in, we have child tax credits,but the figure on tax credits has changed and now only £40 a week, he gets monthly wages and we struggle in between the wage
    I just thought maybe i was entitled to jsa or income support but i guess not

    you try to provide for your family but when one of you gets ill you get punished
