URGENT: work advice/help needed

Today I got called in by my manager(s) for a "chat" apparently the three new nurses have made complaints about my practice. I admitted to all but one of the things (as one of them was completely untrue).

They told me what I was doing wrong etc, and told me I had to do my probhation all over again for the next 12 weeks (I have been there a year soon).

However the only reason my practice has been down for the last few weeks is because I had a relapse in my anxiety and depression. No issues have been raised before this.

I am out of my relapse now, but doing the probhation and constant worry if I am going to keep my job (which I love btw) is going to make me panic more and won't help.

I have to work with the nurse in charge every shift which is not only embarassing, but is completely unneccacery over the sake of a few complaints which was down to depression. I have been working alone for a year now and being with the nurse makes me feel so belittled.

I have writted a letter to my union and have just sent it off. But is there anything I can do. I did not tell my employer I had a relapse as I don't want them to say I am incapable of doing my job due to the depression when it was only a few week relapse.

You all know what it is like when i relapse I ask constant stupid questions and run away with myself.

However, I really do need urgent help now, and am not "trolling". I have not posted here in a while.

I will wait patiently for a response, and sorry it was so long to read.

    I recall you work in the healthcare setting. What did the complaints relate to - did any of them have any connection with patients? If so, the employer has a duty of care towards those patients; you have admitted poor conduct and the employer must make sure that you are safe to work in the environment. This is what they appear to be doing. I think it is reasonable for them to do so - what if your conduct was repeated, to the detriment of patients? - they'd be liable.

    As for the DDA. Yes it can in theory cover the conditions you live with. But I think you misunderstand the purpose of it. The employer can make reasonable adjustments to enable you to access the workplace / work on an equal basis. But that does not extend to putting patients at risk if your performance is poor owing to the condition.

    Also, you didn't tell them about the relapse. The employer is not a mind-reader and therefore couldn't take reasonable steps to alleviate the problem temporarily.

    I think you should take it on the chin and do your best to get through your probation again.

    If your so confident that you can do the job then surely you should be able to pass the 12 week probation. Listen to any advice given by the nurse.
  • And if the 12 week probation takes you over the 1 year its meaningless as you will have protection for unfair dismissal.

    However, yes you will be protected by the equality act but that doesn't mean you can do a bad job and use that as an excuse to get away with it. The company will need to make reasonable adjustments if possible and it may get you a bit more leeway.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    If your condition causes you to perform badly (over a period of a few weeks) don't you think it is your duty to inform your employer?

    You must tell your employer about your depression as this will be a significant factor in your ability at work and your employer maybe able to assist.
    Eat vegetables and fear no creditors, rather than eat duck and hide.
  • thanks for replying guys. Yes the probhation will take me to around 18 months. But I am off sick at the moment going to see the docor I had to call 111 and be taken by ambulance to the hospital due to stress depression anxiety and suicidal thoughts.

    I should of yes but mental illness depression mainly has a stigma. I did not do a bad job just a couple of non harmful silly mistakes.

    im going to see what unison and doc says. I will of been there a year on contract on 31/10/2012. See if re-doing the prob can be revoked as a reasonable ajustment and if i can transfer to nights where it is quieter

    Revoking (ie not exercising) the "probationary" action would not be a reasonable adjustment IMHO. If the probationary period requires you to work under closer supervision that itself is a reasonable adjustment to accommodate what you have done/not done.

    Your request to transfer to nights may or may not be acceptable. If there are fewer staff around, you will have greater individual responsibility.

    You have contradicted yourself here - if you are calling an ambulance you clearly are not out of your relapse.

    I agree with anamenottaken, revoking the probationary period would not be an RA, in fact it would be quite the opposite. This is your chance to prove yourself, and to learn from a more experienced member of staff. Take it as a positive, not something to get you down.
