    What doesn't seem right to you? that your girlfriend enters the country and can't claim benefits?

    What were you thinking that she could come over and sit at home watching TV whilst claiming benefits?... unbelievable, send her down the job center.

    Not quote sure why she has made a claim for Income-Based JSA in her own right if she is living with you; are you claiming JSA? Please clarify as your post doesn't make sense??

  • Hummmmm Ive taken a bit of a bashing here and as I read the replies, I understand them all and I would have said exactly the same.

    So to give some clarity to my thinking and to make sure people don't just think that I or my girl are one of the seemingly endless scroungers around both home grown and imported I add the following.

    I am a mature student and currently pay my fees and support myself (without support). I have always worked both for myself and for companies of various sizes and in varying positions.

    My girl has come to the UK on my invite and there was never any other idea other than us being self supporting while she found a job. which she has applied for any and every position, even the menial ones even though she comes from a management background. A job is a job.

    I have paid my dues into this country as many have here and don't expect a medal for it. Its what we all do.

    When she came here, the first thing we did was call the NI office to apply for her NI number so she would input into our economy and we were told that because she didnt yet have a job, she would have to make a claim for JSA. I went with her and at several points we told everyone that she was new to the UK and not been here or input into our economy, at no stage did anyone question us or point out that she wasn't allowed to claim. We have been strung along by a chain of people who should be able to advise but were never able to.

    We don't want what we haven't earned or were not entitled to, just an NI number.

    Also, after the four weeks she has been here now, my girl has now got a job.

  • Well actually, when you make an initial claim you are given an national insurance reference number while your NI number is being processed.

    So, yes you can get a job before having an NI number.

    But then again, those not born 'last night' would perhaps have known this or asked rather than being a little snotty.

  • Well Thor. I have to admit to being a little nieve here. Yes I have always contributed in terms of N.I. and tax both from employed and self employment. I didn't see this as a 'I've put in .. so I want some back' situation.

    In fact in my thread above I have mentioned that I am back at uni while still earning (No medals wanted, It's my choice) but I am not wealthy and I did mention that we were both happy to be self supporting.

    Our first port of call was to NI application office... just wanted the number so dues would be paid when she got a job, we were directed to the JSA office and told (wrongly as we now know) that a claim could be made.

    We didn't see this as anything other than a very short term option. In fact I saw it as a help that would be repaid to the system many times over in contributions from us both in the future.

    I can understand the comments made here. I would have felt the same and often do (especially after a visit to the JSA office) and watching those that take take take and never put back in, and at 3pm have obviously just got out of bed or turn up in flash cars.
