Job seekers allowance not entitled help please

Hello
My girlfriend has come to live with me in the UK. I am a British national she is Chilean with Spanish nationality and passport.
She has made a claim for Job seekers allowance and as part of this claim an application for an NI number.
4 weeks after making this claim, and much messing around she is now told that she cannot claim JSA as she needs to be in the country for 3 months first. This doesnt seem right to me.
Can anyone advise please?

Doesn't seem right to me either, three months is a ridiculous length of time, should be 3 years.0

There are 2 types of JSA
contribution based - she will not qualify as will not have made the NI contributions
income based - which is based on your household circumstances. If you work she won't qualify and if you don't work are you trying to change your JSA claim to a joint one?0 -

Julian - just where do you think that the money you think ought to be paid to your partner should come from? What will she be contributing to the country? How much have you contributed in tax/ni contributions?0

This is from Shelter's website and explains the 3 months rule (doesn't apply if you are working)
What are my rights when I first arrive?
All EEA/EU nationals have an automatic right to live in the UK for three months after their arrival.
If you are not working during these three months, you will not be eligible to:- apply to go on the council's waiting list for social housing
- get help from the council if you become homeless
- claim social security benefits.

Immigrants should not be allowed benefits until they have been paying tax for a minimum of five years. Sorry but immigrants should never get more out of the system then the amount they have put in. We've already got enough of our own doing that.It's someone else's fault.0 -

She registers with every single job agency that is available, and prepares to take any job going e.g. care work, cleaning, fast food etc. Assuming she is fluent in English, bing bi-lingual will work to her advantage.
I think other posters were irritated by your post because it sounds as if her first stop on arrival was the benefits agency and not the jobcentre.
Many Christmas temporary posts are currently being advertised, (Royal Mail, Boots, Selfridges, Debenhams) if that helps.0 -
