  • Looks like I won't need to go for legal action. Just got this email. She's obviously sought advice and been told she'd be murdered in court.
    To draw a line under this matter and In order to conclude all matter between us .


    I will make a payment into your account today on the basis of written acceptance that it is in full and final settlement of all matters relating to your tenancy .

    nah, it's minus the original offer i made for repairs.

    I'm not vindicitive and have said all along, i don't mind paying my way, but resented her trying to renovate her house with my money.

    also, i just want my housemates money back...it's not his fault...i'd written off my money 5 years ago...i'm just happy i don't have to go through court.

    Glad you've got what you want, but the land lady is getting away with her illegal activity,

    Rather than costing her £4,800 + fees (for not protecting), it’s made her a few hundred pounds (illegal deductions from your none protected deposit).

    I hope she treats the next tenant better, but doubt it since she got away with it in the end.

    I know...if it was 100% of my money i would have gone on to court, but i don't want to risk someone else's money...

    IMO note you are entitled to the full deposit given she will, as you say, get murdered on court so clearly doesn't want to go there. It is a lesson for her and a little float for you: otherwise what incentive is there for her not to do this to the next tenant? If you leave it she has profited from you, you aren't square.

    I've offered my housemate the opportunity to take the money, but told him I am happy to chase the court action if he agrees.

    IMO wait until the bit you have received cleared, then ask why you haven't received the full deposit as per the legislation. You might just get a second lump sum appear in your account with no court action required. ;) Just because SHE said the first payment was full and final doesn't mean you have accepted it is.

    The wording of the email extract implies to me that she'll only make the payment when she's received written acceptance that it will be full and final.
