Landlord refusing to repay deposit, no Inventory, no deposit scheme.

If you go that route I expect they will bring up all sort of "damage" and "cleaning" that needed to be done and all the deposit was used up as their defence, I would also expect there to be a counter claim as the deposit wasn't sufficient to cover this damage but being a nice LL they weren't going to pursue it but now they will.

Well, I made a direct request, threatening legal action if it wasn't resolved on the 18th. she just told me to bring it on.
however, i'll be sending the letter before action today so that will also be included in the small claims action (which we are writing here)
I am including email print-outs, but only the direct request, not the more detailed emails that include all the other stuff. Let me adjust it.0 -
But then I would be prepared to put my claim in the hands of a shonky company knowing that the very least I am likely to get is £1,600 (my deposit back) and then give the shonky company however much they want of any award above that.
I don't mind doing that, if only I could find one. I'm on that landlord zone thing now...but can't find what i need. hmm.

Shall i just change my email a bit and make a letter of it and post it tonight? I don't think I'm going to get the letter before action out tonight as the whole small claims vs solicitor thing has thrown me.0 -
right, i think i'm still going with the small claims thing. I've got the assistance of people on here, and also a friend who is a solicitor has said he can look at my forms before they go out.0

No need to get anything out tonight, you have made a HUGE amount of progress in just one day, very impressive.
IMO work on it over the weekend, mail late on Sunday so it is picked up by the postie first thing Monday. I find it's wise to get a decent first draft, relax with a nice meal and/ or bottle of wine, sleep on it, final draft the next day or day after.

just to comment on the repairs, if the carpet is 5 years old then I can't see her winning by saying it's ditty, and I bet it wasn't new when you first took the flat so wouldn't be surprised it it's closer to 10 years old, same goes for the decorating I would have thought.0
