    No one can simply 'apply' for a court judgement. Unfortunately (for them) they have to go through all that rigmarole of actually taking you to court and winning.

    As their case is useless and you'd win hands down, you can forget about them obtaining a judgement against you.

    Everyone on this site has had these or similar letters from Debt Recovery Plus and happily ignored them. They are meaningless.

    You do not even have a real parking ticket, it's just a piece of rubbish. You should just be playing snap with these template letters against the picture previews info on this forum.

    Like all the other posters on this board, you have a fake PCN.

    As long as it's not a company/hire/lease car (which I assume it's not as they sent the fake PCN to you) then you can just ignore it and ignore the other letters that will arrive. The letters are easy to ignore and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

    The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

    There is no fine, no CCJ, no bailiff, no debt, no effect on credit rating, no Court, no repercussions at all.

    Tick off the threatening letters here.

    Simply choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority. Now you have the pics in that first link you can play snap with each letter until the whole scam fizzles out.

    Apart from not being "legally imposable" one other reason HighView Parking Ltd do NOT take people to Court is....they have outstanding summonses AGAINST them for non-payments!!!
    I found this out when a couple of friends (one disabled) got threatening letters from them for staying more than 2 hours in Livingston Car Park. I advised them to ignore the threats after reading your posts and the "legalities" (or lack of them) in the so-called-Law they quoted (England and Wales only ???).

    Bit of a random thread to attach your unrelated question to.

    There are hundreds of threads here relating to the POFA. Its relevance depends on lots of things, e.g. when did you park there, is it in England or Wales. Not that it makes any difference to anything. Any charge notices from private companies have exactly the same legal standing that they did before, that is to say they are all pretty-much unenforceable. Nothing has changed in that respect.
