Highview Parking Ltd/ Debt recovery plus

Hello,

I parked in a local car park for 10 minutes longer than I should have, therefore received a fine from Highview parking Ltd for £50, every few weeks I get a letter from them and today I received a debt recovery plus letter.

Basically saying I have 7 days to pay or they will forward to their solicitor to commerce court proceedings. Should I pay or just continue to ignore?

    Continue to ignore them, they are scamming scum.

    Ask them which solicitor they will use :)
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    As far as parking charges are concerned I think they should have a name change to Debt Non-Recovery Minus!

    Also maybe Zenith to Nadir ;)
  • hi everyone- i have received a letter today from debt recovery plus (checked their VAT number and it it registered) stating that they want £145.24 due to none payment to Highview Parking...in August..not sure what to do as i have ignored all previous correspondence and now this...a bit worried about credit reports and so on...but in all honestly i really wasn't driving my car that day although i have not entered into any conversation with the firms to say who was..and dont really intend to unless abso necassery.i cant afford to pay it!! Help Im BIT WORRIED :0(

    They cannot possibly affect your credit record - have they indicated that they can?

    The only way a company can affect your credit record is if you sign any kind of loan agreement with them (which you haven't) or they take you to court, win, and you still refuse to pay up.

    None of this will ever happen, and even in the 20,000,000-1 chance it did, you can still pay up before your credit rating is affected.

    Ignore them.

    They can run to their solicitor, they can run to their advanced debt collection agency, and if he were still alive and not disgraced, they could either have written to Jim'll Fix It...

    ...but they're not in a hurry to run to any court because we know Highview and we know Debt Recovery+, and they also know their own selves. Their demand is unlawful in that it exceeds losses and looks more like a de facto penalty so they won't even be trying court. The demand is unenforceable so they would be heading for certain defeat and this is with you not even speaking.

    DO THEY INDEED! If they have phrased it the same way you have then this is the clearest indication yet that you are being penalised. And "penalties" are unlawful when issued by one citizen to another. You're not dealing with an authority here.

    So this will stop you worrying about court:
    when (and if) your antagonist fills out court papers to sue you, the judge will take one look at their demand of £145.24 which they claim is for a non-payment to Highview and he will strike the case out before a hearing is set.

    You won't even know it happened, which is why they will continue to harass you with threatening letters from DR+, solicitors, all sorts... but unless the debt is registered, and you see it cannot be, you don't owe a penny. Take it easy!
