I have spoken to my second cousin, once removed on the phone, and discussed what you (and others) have said here.
He is collecting together all the relevant documentation as suggested, and is going into town later with it to see if the folks at the local CAB office can assist.

I don't think there is any suggestion the previous garage has faked the previous MOT in any way in this regard.The emissions test is just use a machine to take the reading. Why would the previous garage fake this? Most garages would love a car to fail its MOT as it means more money for them!
But as Guardsman confirmed, a lack of proper servicing is a cause for failing the emissions test.

So you accept that 12 months ago the emissions were fine? Is your premise behind your argument that a car that is serviced every year should never fail its emission tests? I find that very unlikely.
I assume that this year the car isn't being serviced as your cousin has just gone straight to the council for an MOT?

Nothing has been confirmed. Nearly a year ago the car was serviced and passed it's MOT. Now it's failed it's MOT 11 mths on, there is no correlation between what happened 11 months ago and now.Yes that was my thought also, hence why I think the previous garage should be brought to task over this.

The exhaust may just need a new cat converter. Replacing an exhaust section is usually quite easy.
Where is the corrosion and what is the age of the car?
There is still no reason to believe this was in any way caused by the garage that last serviced it.!0 -
I notice the OP hasn't given any regard to the comments about the rust not being an issue a year ago, so I'll make it clearer.
The rust might not have even been there a year ago!
Also, a service doesn't guarantee a car will pass emissions. Thinks can break that mess up emission readings.

I gave that as one of the reasons a car could fail it's emission test it's not confirmation that's it's the actual cause.I think the surest sign that intelligent life exists elsewhere in the universe is that none of it has tried to contact us.0 -
If you check with the VOSA an MOT is only valid at the time it was carried out, also you need to take into account the age of the vehicle how many miles it has done in its life and if it is parked outside or in a garage when not in use. Best take it to yet another garage as we once were told our vehicle failed a MOT, took it to another garage where it passed and is still on the road today. We later found out the garage sold MOT failures on through the second hand market at a tidy profit, or hiked the repair bill up for extra cash. OP you do not say why the vehicle was taken to a different garage this year. If it was me I would call VOSA and ask them how you validate an MOT and how long you should expect the service to last as they deal with MOT's everyday.
