  • I certainly don't need legal aid . Yes I have put procedures in place with regards to the confusion of the benefit and will wait and see what the outcome is . It's only a matter of £9.000 roughly but I have worked all my life and that amount now a days is not a great deal . I really appreciate the advice and comments .
  • But your going to waste people on a solicitor? so Times the solicitor fees with the what 3 months backdated child benefit you may get,

    Child benefit is what going from a Google search its £20 roughly a week

    So £20 x 4 weeks a month for 3 months that's what £240

    and most solicitor charge you what per hour these days from anything from £60-100 depending what company you go with

    just seems a waste of money to be honest

    your not going to get £9.000 back whichever way you look at it. just no way will HM Revenue pay that for your own mistake for not checking within 6years

    As you only get Tax Credits if you are entitled to child benefit I suppose there is an argument that as tax credits continued there is proven entitlement but I must admit I've honestly never come across anyone who genuinely didn't know tax credits and child benefit are two seperate things.

    There is some crossover as when I made a change to my CB claim I was asked if I wanted them to advise tax credits and when I said yes the revised CTC paperwork arrived in days-so there is *some* communication between the two entities even if they are administered completely seperately.

    The OP needs to take responsibilty for presuming CB has been replaced or is included in CTC. The CTC forms do not state anywhere now or 6 years ago that CTC has replaced or now includes the award for CB. I would hope any decent solicitor will inform the OP they dont stand a chance in winning this one.
